وَأَخْبَرَنَا أَبُو الْفَتْحِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الرَّيِّسُ بِالرِّيِّ، ثنا جَعْفَرُ بْنُ ⦗١٨١⦘ عَبْدِ اللهِ بْنِ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ هَارُونَ، ثنا أَبُو كُرَيْبٍ، ثنا أَبُو خَالِدٍ الْأَحْمَرُ، وَعُبَيْدُ بْنُ زِيَادٍ الْفَرَّاءُ، عَنْ حَجَّاجٍ، عَنْ حُصَيْنٍ، عَنِ الشَّعْبِيِّ، عَنِ الْحَارِثِ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ قَالَ: " لَا نِكَاحَ إِلَّا بِوَلِيٍّ، وَلَا نِكَاحَ إِلَّا بِشُهُودٍ " رَوَاهُ يَزِيدُ بْنُ هَارُونَ، عَنْ حَجَّاجٍ، وَقَالَ: " لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ " وَهَذَا شَاهِدٌ لِرِوَايَةِ مُجَالِدٍ، وَرُوِّينَاهُ عَنْ عُبَيْدِ اللهِ بْنِ أَبِي رَافِعٍ عَنْ عَلِيٍّ.
It is narrated from Sayyiduna Ali (may Allah be pleased with him): There is no marriage in the absence of a guardian and witnesses. In the narration of (Yazid bin) Harun it reads: There is no marriage without the permission of a guardian and without the presence of two upright witnesses.
