باب: ما أبيح له من الحكم لنفسه، وقبول قول من شهد له بقوله، وإن جاز ذلك جاز أن يحكم لولده وولد ولده
Chapter: It being permitted to him (peace and blessings be upon him) to judge in his own favour and to accept the word of one who testifies for him on his word; and if that is permissible, it is permissible for him to judge in favour of his children and grandchildren

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ أَبُو أُسَامَةَ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أُسَامَةَ الْحَلَبِيُّ، ثنا الْحَجَّاجُ بْنُ أَبِي مَنِيعٍ الرُّصَافِيُّ، حَدَّثَنِي جَدِّي، عَنِ الزُّهْرِيِّ قَالَ: حَدَّثَنِي عُمَارَةُ بْنُ خُزَيْمَةَ، أَنَّ عَمَّهُ، أَخْبَرَهُ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ابْتَاعَ فَرَسًا مِنْ رَجُلٍ مِنَ الْأَعْرَابِ فَاسْتَتْبَعَهُ لِيَقْضِيَهُ ثَمَنَ فَرَسِهِ، فَأَسْرَعَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْمَشْيَ وَأَبْطَأَ الْأَعْرَابِيُّ، وَطَفِقَ رِجَالٌ يَعْتَرِضُونَ الْأَعْرَابِيَّ، فَسَاوَمُوهُ بِالْفَرَسِ، وَلَا يَشْعُرُونَ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَدِ ابْتَاعَهُ حَتَّى زَادَ بَعْضُهُمُ الْأَعْرَابِيَّ فِي السَّوْمِ عَلَى ثَمَنِ الْفَرَسِ الَّذِي ابْتَاعَهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَلَمَّا زَادَهُ نَادَى الْأَعْرَابِيُّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: إِنْ كُنْتَ مُبْتَاعًا هَذَا الْفَرَسَ فَابْتَعْهُ أَوْ لَأَبِيعَنَّهُ، فَقَامَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ سَمِعَ نِدَاءَ الْأَعْرَابِيِّ حَتَّى أَتَاهُ الْأَعْرَابِيُّ، فَقَالَ لَهُ: " أَوَلَسْتُ قَدِ ابْتَعْتُهُ مِنْكَ؟ " فَقَالَ الْأَعْرَابِيُّ: لَا وَاللهِ مَا بِعْتُكَ قَالَ: فَقَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " بَلَى قَدِ ابْتَعْتُهُ مِنْكَ "، فَطَفِقَ النَّاسُ يَلُوذُونَ بِرَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَبِالْأَعْرَابِيِّ وَهُمَا يَتَرَاجَعَانِ، وَطَفِقَ الْأَعْرَابِيُّ يَقُولُ: هَلُمَّ شَهِيدًا يَشْهَدُ أَنِّي بَايَعْتُكَ، فَمَنْ جَاءَ مِنَ الْمُسْلِمِينَ قَالَ لِلْأَعْرَابِيِّ: وَيْلَكَ إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمْ يَكُنْ يَقُولُ إِلَّا حَقًّا، حَتَّى جَاءَ خُزَيْمَةُ فَاسْتَمَعَ مَا يُرَاجِعُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَيُرَاجِعُ الْأَعْرَابِيُّ وَطَفِقَ الْأَعْرَابِيُّ يَقُولُ: " هَلُمَّ شُهَدَاءُ يَشْهَدُونَ أَنِّي بَايَعْتُكَ قَالَ خُزَيْمَةُ: أَنَا أَشْهَدُ أَنَّكَ قَدْ بَايَعْتَهُ فَأَقْبَلَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَلَى خُزَيْمَةَ قَالَ: " بِمَا تَشْهَدُ؟ " قَالَ: بِتَصْدِيقِكَ يَا رَسُولَ اللهِ، فَجَعَلَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ شَهَادَةَ خُزَيْمَةَ شَهَادَةَ رَجُلَيْنِ وَاللهُ أَعْلَمُ.
Umarah bin Khuzaymah (may Allah have mercy on him) narrates from his paternal uncle (who was a Companion) that the Messenger of Allah (peace and blessings be upon him) bought a horse from a Bedouin and asked him to follow him so that he could settle the price of the horse. The Messenger of Allah (peace and blessings be upon him) walked quickly and the Bedouin walked slowly, so people came to the Bedouin and began bargaining with him for the horse, not knowing that the Messenger of Allah (peace and blessings be upon him) had already bought it. Some of them offered a higher price for the horse than the price at which the Messenger of Allah (peace and blessings be upon him) had bought it. When the Bedouin saw the higher price, he called out to the Messenger of Allah (peace and blessings be upon him): If you want to buy this horse, then buy it; otherwise I will certainly sell it. On hearing the call, he (peace and blessings be upon him) stopped, and when the Bedouin came to him, he (peace and blessings be upon him) said to him: "Have I not already bought it from you?" The Bedouin said: By Allah, I did not sell it to you. The Messenger of Allah (peace and blessings be upon him) said: "Indeed I have bought it from you." People gathered around him (peace and blessings be upon him) and the Bedouin. The Bedouin said: Bring a witness who will testify that I sold it to you. Some Muslims said to the Bedouin: Woe to you! The Messenger of Allah (peace and blessings be upon him) speaks nothing but the truth. Then Sayyiduna Khuzaymah (may Allah be pleased with him) came and listened to the words of the Messenger of Allah (peace and blessings be upon him) and of the Bedouin, and the Bedouin was saying: Bring a witness who will testify that I sold the horse to you (peace and blessings be upon him). Sayyiduna Khuzaymah (may Allah be pleased with him) said: I bear witness that you sold it to him (peace and blessings be upon him). The Messenger of Allah (peace and blessings be upon him) turned to Sayyiduna Khuzaymah (may Allah be pleased with him) and asked: "On what basis do you testify?" He said: On the basis of believing you to be truthful, O Messenger of Allah. So the Messenger of Allah (peace and blessings be upon him) made the testimony of Sayyiduna Khuzaymah (may Allah be pleased with him) equal to the testimony of two men. And Allah knows best.
