Bayhaqi 12543 — The abrogation of bequests to parents and relatives

قَالَ: وَحَدَّثَنَا سَعِيدٌ، ثنا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ فِي آيَةِ الْوَصِيَّةِ قَالَ: " كَانَتِ الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالْأَقْرَبِينَ، فَنَسَخَ مِنْ ذَلِكَ للْوَالِدَيْنِ، وَأَثْبَتَ لَهُمَا نَصِيبَهُمَا فِي سُورَةِ النِّسَاءِ، وَنَسَخَ مِنَ الْأَقْرَبِينَ كُلَّ وَارِثٍ، وَبَقِيَتِ الْوَصِيَّةُ لِلْأَقْرَبِينَ الَّذِينَ لَا يَرِثُونَ ".
Al-Hasan (may Allah have mercy on him) said concerning the verse of bequest: The bequest was for the parents and the relatives. It was abrogated for the parents, and their share was fixed for them in Surah al-Nisa'; and from the relatives every heir was abrogated, and the bequest was kept for those relatives who are not heirs.
