أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الصَّفَّارُ، ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ، ثنا سُلَيْمَانُ بْنُ حَرْبٍ، ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ، أنبأ أَبُو يَعْلَى، ثنا أَبُو الرَّبِيعِ، قَالَا: ثنا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ قَالَ: كَانَ ابْنُ عُمَرَ يُكْرِي مَزَارِعَهُ عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَأَبِي بَكْرٍ وَعُمَرَ وَعُثْمَانَ وَصَدْرًا مِنْ إِمَارَةِ مُعَاوِيَةَ رَضِيَ اللهُ عَنْهُمْ، فَأَتَاهُ رَجُلٌ فَقَالَ: إِنَّ رَافِعًا يَزْعُمُ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ كِرَاءِ الْأَرْضِ " قَالَ نَافِعٌ: فَانْطَلَقَ ابْنُ عُمَرَ إِلَى رَافِعٍ، وَانْطَلَقْتُ مَعَهُ، فَقَالَ لَهُ ابْنُ عُمَرَ: مَا الَّذِي بَلَغَنِي عَنْكَ تَذْكُرُ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي كِرَاءِ الْمَزَارِعِ؟ قَالَ: نَعَمْ، " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ كِرَاءِ الْمَزَارِعِ " وَكَانَ ابْنُ عُمَرَ إِذَا سُئِلَ عَنْهُ بَعْدَ ذَلِكَ قَالَ: زَعَمَ رَافِعٌ أَنَّ نَبِيَّ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْهُ، قَالَ نَافِعٌ: فَقَالَ ابْنُ عُمَرَ لَمَّا ذَكَرَ رَافِعٌ مَا ذَكَرَ: قَدْ كُنْتُ أَعْلَمُ أَنَّا نُكْرِي مَزَارِعَنَا عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِمَا عَلَى الْأَرْبِعَاءِ وَشَيْءٍ مِنَ التِّبْنِ لَا أَحْفَظُهُ رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ سُلَيْمَانَ بْنِ حَرْبٍ، وَرَوَاهُ مُسْلِمٌ عَنْ أَبِي الرَّبِيعِ.
Nafi' said: Ibn Umar (may Allah be pleased with them both) used to rent out his land in the time of the Messenger of Allah (peace and blessings be upon him), Abu Bakr, Umar and Uthman, and at the beginning of the rule of Mu'awiyah (may Allah be pleased with them). A man came to him and said: Rafi' claims that the Prophet (peace and blessings be upon him) forbade renting out land. Nafi' said: Ibn Umar (may Allah be pleased with them both) and I went to Rafi'. Ibn Umar (may Allah be pleased with them both) said: Something has reached me from you, that you narrate from the Prophet (peace and blessings be upon him) about renting out land? Rafi' said: "Yes! The Messenger of Allah (peace and blessings be upon him) forbade it." After that, whenever Ibn Umar (may Allah be pleased with them both) was asked about it, he would say: "Rafi' claims that the Prophet (peace and blessings be upon him) forbade it." Nafi' said: After Rafi' (had spoken), Ibn Umar (may Allah be pleased with them both) said: "I remember that in the time of the Messenger of Allah (peace and blessings be upon him) we used to give out our fields in return for (what lay along) the water channels and a little grass."
