أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، ثنا أَحْمَدُ بْنُ مُحَمَّدٍ، ثنا حَسَنُ بْنُ مُكْرَمٍ، ثنا أَبُو النَّضْرِ، ثنا شُعْبَةُ، عَنْ أَبِي الْهَيْثَمِ أَنَّهُ قُدِّمَ دُهْنٌ لَهُ مِنَ الْبَصْرَةِ، وَأَنَّهُ اسْتَأْجَرَ حَمَّالًا يَحْمِلُهُ، وَالْقَارُورَةُ ثَمَنُهَا ثَلَاثُمِائَةٍ أَوْ أَرْبَعُمِائَةٍ، فَوَقَعَتِ الْقَارُورَةُ وَانْكَسَرَتْ، فَأَرَدْتُ أَنْ يُصَالِحَنِي، فَأَبَى، فَخَاصَمْتُهُ إِلَى شُرَيْحٍ، فَقَالَ لَهُ شُرَيْحٌ: " إِنَّمَا أَعْطَى الْأَجْرَ لِتُضَمِّنَ " فَضَمَّنَهُ شُرَيْحٌ، ثُمَّ لَمْ يَزَلِ النَّاسُ حَتَّى صَالَحْتُهُ.
Shu'bah (may Allah have mercy on him) narrates from Abu al-Haytham that some oil of his was brought from Basrah, and he hired a porter to carry it; the flask was worth three or four hundred. It fell and broke. I wanted him to settle with me, but he refused, so I took the matter to Shurayh (may Allah have mercy on him). Shurayh (may Allah have mercy on him) said to him: He gave the wage only so that you would be liable. Qadi Shurayh (may Allah have mercy on him) held him liable; then people kept trying until I settled with him.
