Bayhaqi 11462 — Two men testified before him; one of them testified

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو بَكْرٍ أَحْمَدُ بْنُ إِسْحَاقَ الْفَقِيهُ، أنبأ إِسْمَاعِيلُ بْنُ إِسْحَاقَ، ثنا حَفْصٌ، وَسُلَيْمَانُ بْنُ حَرْبٍ، قَالَا: ثنا شُعْبَةُ، عَنِ الْحَكَمِ، عَنْ شُرَيْحٍ قَالَ: " شَهِدَ عِنْدَهُ رَجُلَانِ شَهِدَ أَحَدُهُمَا عَلَى أَلْفٍ وَثَلَاثِمِائَةٍ، وَشَهِدَ الْآخَرُ عَلَى أَلْفٍ، فَقَضَى عَلَيْهِ بِأَلْفٍ، فَقَالَ: تَقْضِي عَلَيَّ وَقَدِ اخْتَلَفَتْ شَهَادَتُهُمَا؟ قَالَ: اسْتَقَامَتْ عَلَى أَلْفٍ " وَقَالَ سُلَيْمَانُ: إِنَّهُمَا قَدِ اجْتَمَعَا عَلَى أَلْفٍ.
It is narrated from Shurayh (may Allah have mercy on him) that two men testified before him; one of them testified to one thousand three hundred and the other testified to one thousand, so he ruled against him (the defendant) for one thousand. He said: You rule against me when their testimonies differ? He said: They agree on one thousand. Sulayman said: The two of them concurred on one thousand.
