أَخْبَرَنَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زَكَرِيَّا، أنبأ أَبُو طَاهِرٍ مُحَمَّدُ بْنُ الْفَضْلِ، ثنا جَدِّي مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ، ثنا عَلِيُّ بْنُ حُجْرٍ، ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ، ثنا مُحَمَّدُ بْنُ أَبِي حَرْمَلَةَ، أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ: أَفْلَسَ مَوْلًى لِأُمِّ حَبِيبَةَ زَوْجِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَاخْتُصِمَ فِيهِ إِلَى عُثْمَانَ رَضِيَ اللهُ عَنْهُ، فَقَضَى عُثْمَانُ " أَنَّ مَنْ كَانَ اقْتَضَى مِنْ حَقِّهِ شَيْئًا قَبْلَ أَنْ يَتَبَيَّنَ إِفْلَاسُهُ فَهُوَ لَهُ، وَمَنْ عَرَفَ مَتَاعَهُ فَهُوَ لَهُ ".
Sa'id bin al-Musayyib (may Allah have mercy on him) said: A freed slave of the Mother of the Believers Sayyidah Umm Habibah (may Allah be pleased with her) became bankrupt, and the dispute was brought to Sayyiduna Uthman (may Allah be pleased with him). Sayyiduna Uthman (may Allah be pleased with him) said: Whatever a person had already received before his bankruptcy became clear belongs to him, and whoever finds his own goods exactly as they were has more right to them.
