أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ، أنا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ جَعْفَرِ بْنِ دَرَسْتَوَيْهِ، ثنا يَعْقُوبُ بْنُ سُفْيَانَ الْفَارِسِيُّ، ثنا عَبْدَانُ بْنُ عُثْمَانَ بْنِ جَبَلَةَ بْنِ أَبِي رَوَّادٍ، أَخْبَرَنِي أَبِي، عَنْ شُعْبَةَ، قَالَ: سَمِعْتُ عَبْدَ رَبِّهِ بْنِ سَعِيدٍ يُحَدِّثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: " أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ، وَأَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا وَلَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " قَالَ شُعْبَةُ: فَحَدَّثْتُهُ بِحَدِيثِ أَيُّوبَ، عَنْ نَافِعٍ أَنَّهُ حَدَّثَ بِالنَّخْلِ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَالْمَمْلُوكِ عَنْ عُمَرَ، فَقَالَ عَبْدُ رَبِّهِ: لَا أَعْلَمُهَا إِلَّا عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ قَالَ مَرَّةً أُخْرَى، فَحَدَّثَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يَشُكَّ، وَرَوَاهُ سُلَيْمَانُ بْنُ مُوسَى، عَنْ نَافِعٍ مَرْفُوعًا.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said that the Messenger of Allah (peace and blessings be upon him) said: "Whoever sells palm trees after pollination, their fruit belongs to the first owner; and whoever sells a slave who has property, the property belongs to the first owner, unless the buyer stipulates (otherwise)." Shu'bah said: I told (him) the hadith of Ayyub from Nafi', in which the story of the palm trees is from the Prophet (peace and blessings be upon him) and the story of the slave is from Sayyiduna Umar (may Allah be pleased with him). Abd Rabbih said that both stories are from the Prophet (peace and blessings be upon him).
