باب: من باع ثمر حائطه، واستثنى منه مكيلة مسماة فلا يجوز؛ لنهيه عن الثنيا؛ ولما فيه من الغرر
Chapter: One who sells the fruit of his orchard and excepts a specified measure from it, which is not permissible because of his prohibition of exceptions and because of the uncertainty involved

وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنا مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا عُمَرُ بْنُ يَزِيدَ السَّيَّارِيُّ أَبُو حَفْصٍ، ثنا عَبَّادُ بْنُ الْعَوَّامِّ، عَنْ سُفْيَانَ بْنِ حُسَيْنٍ، عَنْ يُونُسَ بْنِ عُبَيْدٍ، عَنْ عَطَاءٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ، قَالَ: " نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُزَابَنَةِ، وَالْمُحَاقَلَةِ، وَعَنِ الثُّنْيَا إِلَّا أَنْ تُعْلَمَ ".
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) says that the Messenger of Allah (peace and blessings be upon him) forbade "al-muzabanah (muzabanah) and al-muhaqalah (muhaqalah), and al-thunya (an exception) as well, but if it is known, then it is permissible."
