باب في تَزْوِيجِ الْمُحْرِمِ:Chapter: Marriage Contract for the Pilgrim

حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ، حَدَّثَنَا شُعْبَةُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنْ ابْنِ عَبَّاسٍ، قَالَ: "تَزَوَّجَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ مُحْرِمٌ".
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) contracted marriage while he was in the state of Ihram.
Brief Explanation

There is a prohibition against contracting or arranging a marriage while in the state of ihram (as narrated by Muslim).
Some scholars have interpreted this hadith to mean that the Messenger of Allah (sallallahu alayhi wa sallam) performed the marriage within the boundaries of the Haram, not while in the state of ihram. Furthermore, they state that there was an error on the part of Sayyiduna Ibn Abbas (radi Allahu anhuma) in this narration, because his maternal aunt, Sayyidah Maymunah (radi Allahu anha), refutes this by stating that the marriage which took place in that state contradicts his narration, as will be mentioned ahead.
