Mustadrak al-Hakim — Hadith 7774

أخبرنا أبو بكر محمد بن عبد الله الشافعي، حدثنا محمد بن الفَرَج، حدثنا حجَّاج بن محمد، حدثنا ابن جُرَيج، عن ابن خُثَيم، عن يوسف بن ماهَكَ، عن حَفْصة بنت عبد الرحمن، عن عائشة: أنَّ النبي ﷺ أمرَ في الفَرَع في كلِّ خمسةٍ واحدةً (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Prophet (peace and blessings be upon him) gave an order regarding the fara' (sacrificing the first offspring of a she-camel): that one out of every five (camels) should be sacrificed.
This hadith has a sahih (authentic) chain, and they (the two Shaykhs) did not record it.

(1) رجاله ثقات غير ابن خثيم -وهو عبد الله بن عثمان المكي- فهو وإن كان صدوقًا إلَّا أنه تفرّد بهذا المتن ولم يتابعه عليه أحد، ولا يحتمل مثل هذا التفرد، كما أنه اضطرب في لفظه كما سيأتي، وجاء عن نُبيشة الهذلي ما يُفهَم منه المخالفة لهذا الحديث.
Technical note / Defect ('illah): Its narrators are thiqah except Ibn Khuthaym ('Abd Allah bin 'Uthman al-Makki); although he is truthful (saduq), he is alone in narrating this matn and no one corroborated him, and such isolated narration from a narrator like him is not acceptable. Moreover, he was inconsistent (idtirab) in its wording, as will come. In addition, reports have come from Nubayshah al-Hudhali (may Allah be pleased with him) from which a contradiction of this hadith is understood.
هكذا رواه حجاج بن محمد -المصيصي- عن ابن جريج بلفظ: في كل خمسة واحدة.
Details of the narration: Hajjaj bin Muhammad al-Massisi narrated it from Ibn Jurayj with the words: "One out of every five (camels or animals)."
ورواه عبد الرزاق (7997)، ومن طريقه البيهقي 9/ 312، والحازمي في "الاعتبار" ص 156 - 157 عن ابن جريج، عن ابن خشيم، به. بلفظ: من كل خمسين بواحدة! وانظر اختلافات أخرى فيه على ابن جريج في "علل الدارقطني" 15/ 406 - 409.
Reference / Source: Imam 'Abd al-Razzaq narrated it in (7997), and by his route Imam al-Bayhaqi 9/ 312 and Imam al-Hazimi in "al-I'tibar" (p. 156-157), from Ibn Jurayj, from Ibn Khuthaym, but with the words: "One out of every fifty!"

وتابعه على الخمسين القاسمُ بن يحيى المقدمي عن ابن خثيم، أخرجه الطبراني في "الأوسط" (1536).
Corroborating chains and supporting reports: In mentioning the number "fifty", al-Qasim bin Yahya al-Muqaddami corroborated (Ibn Jurayj) in narrating from Ibn Khuthaym; Imam al-Tabarani narrated it in "al-Mu'jam al-Awsat" (1536).
وخالف وهبُ بن خالد ابنَ جريج -من رواية عبد الرزاق عنه- والقاسمَ بن يحيى المقدّمي، فرواه عن ابن خثيم كرواية المصنِّف: "من الخمسة واحدة"، أخرجه أحمد 41/ (44530).
Technical note / Defect ('illah): Wahb bin Khalid differed from Ibn Jurayj (according to 'Abd al-Razzaq's narration from him) and from al-Qasim bin Yahya al-Muqaddami; he narrated from Ibn Khuthaym the words "one out of five", like the narration of the author (al-Hakim). Imam Ahmad narrated it in 41/ (44530).

Technical note / Defect ('illah): Hammad bin Salamah also narrated it from Ibn Khuthaym, but those who narrated it from him also differed about it:
فرواه عنه عفّان بن مسلم عند أحمد 42/ (25250)، وعبد الصمد بن عبد الوارث عنده 43/ (26134)، كلاهما عن ابن خثيم بلفظ: "من كل خمس شياه شاة".
Details of the narration: 'Affan bin Muslim, in the narration of Imam Ahmad (42/ 25250), and 'Abd al-Samad bin 'Abd al-Warith, in the narration of Imam Ahmad (43/ 26134), narrated it via Hammad bin Salamah from Ibn Khuthaym with the words: "One goat out of every five goats."
ورواه موسى بن إسماعيل عند أبي داود (2833) عن حماد، عن ابن خثيم، بلفظ: "من كل خمسين شاة شاة".
Details of the narration: Musa bin Isma'il, in the narration of Imam Abu Dawud (2833), narrated it from Hammad bin Salamah, from Ibn Khuthaym, with the words: "One goat out of every fifty goats."
وأما حديث نُبيشة الهذلي فأخرجه أحمد 34/ (20723)، وأبو داود (2830)، وابن ماجه (3167)، والنسائي (4541)، ولفظه: قالوا: يا رسول الله إنا كنا نُفرع في الجاهلية فَرَعًا، فما تأمرنا؟ قال: "في كل سائمة فرعٌ تَعْذُوه ماشيتك، حتى إذا استَحمَل ذَبَحتَه فتصدّقت بلحمه". فلم يأمرهم بعدد بعد أن سألوه ما يجب عليهم فيه. وإسناده صحيح.
Reference / Source: The hadith of Nubayshah al-Hudhali (may Allah be pleased with him) was narrated by Imam Ahmad 34/ (20723), Abu Dawud (2830), Ibn Majah (3167) and al-Nasa'i (4541).
Details of the narration: Its wording is: The Companions said: O Messenger of Allah! In the Jahiliyyah we used to slaughter the "fara'" (the first offspring); what do you command us now regarding it? He (peace and blessings be upon him) said: "In every grazing animal (sa'imah) there is a fara', which your livestock nourish, until, when it becomes able to carry loads, you slaughter it and give its meat in charity." Here he (peace and blessings be upon him) did not fix any particular number (such as one in every five or fifty), even though the questioners asked about what was obligatory.
Grading: Its chain is sahih.
