Mustadrak al-Hakim — Hadith 7368

أخبرنا محمد بن علي الشَّيباني بالكوفة، حدثنا أحمد بن حازم، حدثنا أبو غسان، حدثنا عبد السلام بن حرب، حدثنا يونس بن عُبيد، عن زياد بن جُبير، عن سعد قال: لمَّا بايعَ النبيُّ ﷺ النِّساءَ، قامَتْ إليه امرأةٌ جليلةٌ كأنها من نساء مُضَر، فقالت: يا رسولَ الله، إنا كَلٌّ على آبائِنا وأبنائنا وأزواجِنا، فما يَحِلَّ لنا من أموالِهم؟ قال: "الرَّطْبُ تأكلْنَه وتُهدِينَه" (5). وقد رواه سفيان الثَّوري عن يونس بن عُبيد:

It is narrated from Sayyiduna Sa'd bin Abi Waqqas (may Allah be pleased with him) that when the Prophet (peace and blessings be upon him) took the pledge of allegiance from the women, a dignified woman who appeared to be from the tribe of Mudar stood up and said: O Messenger of Allah! We are dependent on our fathers, our sons and our husbands (that is, we are under their care), so what is lawful for us from their wealth? He (peace and blessings be upon him) said: "Fresh food (or fruit), which you may eat yourselves and give to others as gifts."

(5) رجاله ثقات، لكن اختُلِفَ في نسبة سعد هذا، فجعله البعض سعد بن أبي وقاص كالبزار وعبد بن حميد في "مسنديهما"، وعليه تكون رواية زياد بن جبير هذه عنه مرسلة فيما قاله أبو زرعة وأبو حاتم الرازيان، بينما رجَّح الدارقطني في "العلل" (4/ 645) أنه رجل من الأنصار بعثه النبي ﷺ على الصدقة، وتبعه ابن حجر على ذلك في "الإصابة" 3/ 94 وقال: وأفرده البغوي وابن منده؛ يعني عن ترجمة ابن أبي وقاص لهذا قال أبو حاتم - كما في "العلل" (2426) -: حديث مضطرب.
Grading: All its narrators are thiqah (trustworthy), but there is disagreement about the identity of "Sa'd" in this chain.
Technical note / Defect ('illah): Some hadith scholars, such as al-Bazzar and 'Abd bin Humayd in their "Musnads", identified him as "Sa'd bin Abi Waqqas", on which basis this narration of Ziyad bin Jubayr from him would be "mursal" (as Abu Zur'ah and Abu Hatim al-Razi held). Al-Daraqutni, however, preferred in "al-'Ilal" (4/ 645) that he is a man of the Ansar whom the Prophet (peace and blessings be upon him) appointed to collect the sadaqah. Ibn Hajar followed him in this in "al-Isabah" 3/ 94 and said that al-Baghawi and Ibn Mandah mentioned him separately (from Ibn Abi Waqqas). Abu Hatim declared this hadith "mudtarib" (inconsistent) in "al-'Ilal" (2426).
وذهب ابن القطان الفاسي في بيان الوهم والإيهام 5/ 577 - 578 إلى أنَّ الحديث موصول وصحيح وليس بمرسل محتجًّا بأنَّ المرسل هو عن سعد الأنصاري صاحب السِّعاية وليس عن سعد بن أبي وقاص، لأنَّ عبد السلام بن حرب وسفيان الثَّوري روياه بإسناد المصنف فقالا فيه: عن زياد بن جبير عن سعد.
Important point: Ibn al-Qattan al-Fasi held in "Bayan al-Wahm wa al-Iham" 5/ 577-578 that this hadith is "mawsul" (connected) and "sahih", not mursal. His argument is that the mursal narration is the one from Sa'd al-Ansari (the sadaqah collector), not from Sa'd bin Abi Waqqas, because 'Abd al-Salam bin Harb and Sufyan al-Thawri narrated it with the author's chain, saying in it: "from Ziyad bin Jubayr, from Sa'd".
أبو غسان: هو مالك بن إسماعيل النهدي.
Note / Clarification: Abu Ghassan is Malik bin Isma'il al-Nahdi.
وأخرجه أبو داود (1686) عن محمد بن سوار، عن عبد السلام بن حرب، بهذا الإسناد.
Reference / Source: Abu Dawud narrated it in (1686) through the route of Muhammad bin Sawwar, from 'Abd al-Salam bin Harb, with this same chain.
والرَّطُب، قال ابن الأثير في "النهاية": أراد ما لا يدخر ولا يبقى كالفواكه والبقول والأطبخة، وإنما خصَّ الرَّطْب لأنَّ خَطبه أيسر، والفساد إليه أسرع، فإذا ترك ولم يؤكل هلك، فوقعت المسامحة في ذلك بترك الاستئذان، وهذا فيما بين الآباء والأمهات والأبناء، دون الأزواج والزوجات فليس لأحدهما أن يفعل شيئًا إلَّا بإذن صاحبه.
Note / Clarification: About the word "al-ratb", Ibn al-Athir wrote in "al-Nihayah" that it means things that are not stored and spoil quickly, such as fruits, vegetables and cooked food.
General principle: Fresh things are singled out because their matter is lighter and they spoil quickly; if they are left, they will go to waste. Therefore leeway has been given to eat them without permission. This concession is between parents and children, not between husband and wife, because it is not permissible for either of them to do (such a thing) without the other's permission.
