Mustadrak al-Hakim — Hadith 7241

حدثنا أبو بكر بن إسحاق، أخبرنا محمد بن أيوب، أخبرنا عمار بن هارون. وأخبرني عبد الله بن محمد بن زياد العَدْل، حدثنا محمد بن إسحاق، حدثنا إبراهيم بن خُثَيم، حدثني أبي، عن جدِّي عِرَاك بن مالك (2)، عن أبي هريرة: أنَّ النبي ﷺ حَبَسَ رجلًا في تُهمةٍ يومًا وليلةً، استظهارًا واحتياطًا (3).

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) imprisoned a man on the basis of an accusation for a day and a night, for thorough investigation and as a precaution.

(2) أقحم في نسخنا الخطية بين عراك بن مالك وأبي هريرة عن أبيه.
Important point: In our manuscripts the intermediary "an abihi" (from his father) was mistakenly inserted between Irak bin Malik and Abu Hurayrah.

(3) إسناده ضعيف جدًّا، إبراهيم بن خثيم متروك كما قال الذهبي في "تلخيصه"، وقال العقيلي: لا يُتابع إبراهيم عليه. وقد روي عن عراك مرسلًا، وهو الصواب.
Grading: This chain is "da'if jiddan" (extremely weak).
Technical note / Defect ('illah): Ibrahim bin Khuthaym is a "matruk" (abandoned) narrator, as Imam al-Dhahabi said in the "Talkhis", and al-Uqayli said that Ibrahim is not corroborated in this narration. This narration is reported from Irak as "mursal", and that is what is correct.
وأخرجه البزار (8144) و (8145)، و أبو يعلى كما في "المطالب العالية" (1881)، والعقيلي في "الضعفاء الكبير" (52)، وابن عدي في "الكامل" 1/ 243، وأبو نعيم في "الحلية" 10/ 114، والبيهقي 6/ 77 من طرق عن إبراهيم بن خثيم، بهذا الإسناد. وفي لفظ عند البزار والعقيلي: أنَّ النبي ﷺ كفل في تهمة، وعند ابن عدي ومن طريقه البيهقي: أخذ من متهم كفيلًا تثبيتًا واحتياطًا، وعند أبي نعيم: حبس حبسًا يسيرًا حتى استبرأ.
Details of the narration: Al-Bazzar (8144, 8145), Abu Ya'la (al-Matalib al-Aliyah: 1881), al-Uqayli (al-Du'afa' al-Kabir: 52), Ibn Adi (al-Kamil: 1/243), Abu Nu'aym (al-Hilyah: 10/114) and al-Bayhaqi (6/77) narrated it through the routes of Ibrahim bin Khuthaym. With variation in wording: in al-Bazzar and al-Uqayli it says that the Prophet (peace and blessings be upon him) took a surety (kafalah) in a case of suspicion; in Ibn Adi and al-Bayhaqi it says that he (peace and blessings be upon him) took a guarantor from a suspected person for confirmation and as a precaution; and in Abu Nu'aym it says that he (peace and blessings be upon him) detained him for a short while until the matter was investigated.
وأخرجه عبد الرزاق (18892) عن ابن جريج، والعقيلي (57) من طريق أبي بكر بن عياش، كلاهما عن عراك بن مالك، فذكره مطولًا مرسلًا، وسنده صحيح إلى عراك. وأعل العقيلي حديثَ إبراهيم بن خثيم الموصول بهذه الرواية المرسلة.
Technical note / Defect ('illah): Abd al-Razzaq (18892) narrated it from Ibn Jurayj, and al-Uqayli (57) by way of Abu Bakr bin Ayyash; both of them narrate it from Irak bin Malik as "mursal", and this chain up to Irak is sahih. Al-Uqayli declared the mawsul narration of Ibrahim bin Khuthaym defective (weak) on the basis of this very mursal narration.
