(3) إسناده ضعيف، الفيض بن الفضل روى عنه جمع، وذكره ابن حبان في "ثقاته"، وقد خولف في رفعه، واختلف فيه أيضًا على مسعر بن كدام، وعلى أبي صادق - وهو الأزدي الكوفي - كما سيأتي. والموقوف أصحُّ كما قال الدارقطني في "العلل" (359)، وربيعة بن ناجذ لم يذكروا عنه راويًا غير أبي صادق، وقال الذهبي في "الميزان": لا يكاد يعرف، وذكره ابن حبان في "ثقاته".
Grading: Its chain is "da'if" (weak).
Technical note / Defect ('illah): A group narrated from al-Fayd bin al-Fadl, and Ibn Hibban mentioned him in "al-Thiqat", but he was contradicted in narrating this report as "marfu'". There is also disagreement in it over Mis'ar bin Kidam and over Abu Sadiq al-Azdi.
Important point: Al-Daraqutni said in "al-'Ilal" (359) that its being "mawquf" is more correct. About Rabi'ah bin Najidh, al-Dhahabi said: "He is hardly known (i.e. majhul)."
وقوله فيه: "اسمعوا وأطيعوا ما لم يخير … إلخ" منكر.
Technical note / Defect ('illah): The words in this narration, "Listen and obey as long as you are not given a choice (between your religion and your life)", and what follows, are munkar (denounced).
وأخرجه تامًّا ومختصرًا البزار (759)، وابن الأعرابي في "معجمه" (2320)، والطبراني في "الأوسط" (3521)، وفي "الصغير" (425)، وأبو نعيم في "الحلية" 7/ 242، وأبو عمرو الداني في "الفتن" (203)، والبيهقي 8/ 143، والضياء في "المختارة" 2/ (450)، والرافعي في "التدوين في أخبار قزوين" 2/ 422 من طرق عن الفيض بن الفضل البجلي، بهذا الإسناد.
Reference / Source: This narration was narrated in full and in abridged form by al-Bazzar (759), Ibn al-A'rabi (2320), al-Tabarani in "al-Awsat" (3521) and "al-Saghir" (425), Abu Nu'aym in "al-Hilyah" 7/ 242, Abu Amr al-Dani in "al-Fitan" (203), al-Bayhaqi 8/ 143, al-Diya' al-Maqdisi in "al-Mukhtarah" 2/ (450) and al-Rafi'i in "al-Tadwin" 2/ 422, by various routes from al-Fayd bin al-Fadl al-Bajali, with this chain.
وخالف الفيضَ وكيعٌ عند ابن أبي شيبة 12/ 172 و 544، وابن أبي عاصم في السنة" (1513)، وأبي بكر الخلال في "السنة" (63)، وشعيبُ بنُ إسحاق عند أبي عمرو الداني في "الفتن" (204)، فروياه عن مسعر، عن عثمان بن المغيرة، عن أبي صادق، عن ربيعة، عن علي موقوفًا. جعلا شيخ مسعر عثمان، ووقفاه. ووقع في رواية ابن أبي عاصم مكان مسعر سفيان، ونظنه تحريفًا من الناسخ.
Technical note / Defect ('illah): Waki' and Shu'ayb bin Ishaq contradicted al-Fayd (bin al-Fadl).
Reference / Source: In Ibn Abi Shaybah 12/ 172 and 544, Ibn Abi Asim's "al-Sunnah" (1513), Abu Bakr al-Khallal's "al-Sunnah" (63) and Abu Amr al-Dani (204), the two of them narrated it with the chain Mis'ar bin Kidam, from Uthman bin al-Mughirah, from Abu Sadiq, from Rabi'ah, as "mawquf" on Ali (may Allah be pleased with him). They both named Mis'ar's teacher as "Uthman" and kept it mawquf.
Note / Clarification: In the narration of Ibn Abi Asim the name "Sufyan" (al-Thawri) appears in place of Mis'ar, which is probably a copyist's error (tahrif).
وكذلك رواه أبو عوانة عن عثمان بن المغيرة موقوفًا، والموقوف أشبه بالصواب. قاله الدارقطني في "العلل".
Important point: Likewise Abu Awanah also narrated it from Uthman bin al-Mughirah as "mawquf".
Grading: Al-Daraqutni said in "al-'Ilal" that its being mawquf is closer to what is correct.
وخالفهم داودُ بن عبد الجبار كما في "علل الدارقطني" 3/ 199، فرواه عن مسعر، عن عثمان بن المغيرة، عن أبي صادق، به مرفوعًا. وداود بن عبد الجبار تالفٌ لا يُفرح به.
Technical note / Defect ('illah): Dawud bin Abd al-Jabbar contradicted all of them and narrated it with the chain Mis'ar, from Uthman bin al-Mughirah, as "marfu'" (as a saying of the Prophet (peace and blessings be upon him)).
Grading: Dawud bin Abd al-Jabbar is a "talif" (utterly unreliable) narrator; his narration carries no weight.
ورواه قبيصة بن عقبة عن سفيان الثوري عند ابن أبي شيبة 12/ 171 - وعنه ابن أبي عاصم في السنة" (1514) - عن الحارث بن حَصيرة، عن أبي صادق، عن علي موقوفًا. ليس فيه ربيعة بن ناجذ. وقبيصة في سفيان فيه كلام، والحارث بن حصيرة ضعيف يعتبر به.
Reference / Source: Qabisah bin Uqbah narrated it from Sufyan al-Thawri, from al-Harith bin Hasirah, from Abu Sadiq, from Ali, as mawquf.
Technical note / Defect ('illah): In this chain Rabi'ah bin Najidh is not mentioned. There is criticism of Qabisah's narrations from Sufyan al-Thawri, and al-Harith bin Hasirah is weak, but he may be considered for corroboration (i'tibar).
وأخرجه ابن أبي شيبة 15/ 23 عن وكيع، عن إبراهيم بن مرثد، عن عمه أبي صادق، عن علي، قال: الأئمة من قريش، ومن فارق الجماعة شبرًا فقد نزع ربقة الإسلام من عنقه. وإبراهيم بن مرثد مجهول.
Reference / Source: Ibn Abi Shaybah 15/ 23 narrated it with the chain Waki', from Ibrahim bin Marthad, from (his paternal uncle) Abu Sadiq, from Ali, (saying): "The imams are from Quraysh."
Technical note / Defect ('illah): Ibrahim bin Marthad is a "majhul" narrator.
وأخرجه عبد الله بن أحمد في زوائده على "المسند" 2/ (790)، والبزار (512)، والدارقطني في "العلل" (426) من طريقين عن محمد بن جابر، عن عبد الملك بن عمير، عن عمارة بن رويبة، عن علي مرفوعًا: "الناس تبع لقريش برُّهم لبرهم، وفاجرُهم تبع لفاجرهم". ومحمد بن جابر - وهو ابن سيار السحيمي - ضعيف.
Reference / Source: Abdullah bin Ahmad in "Zawa'id al-Musnad" 2/ (790), al-Bazzar (512) and al-Daraqutni narrated it with the chain Muhammad bin Jabir, from Abd al-Malik bin Umayr, from Umarah bin Ruwaybah, from Ali, as marfu': "The people follow Quraysh: the righteous among them follow their righteous, and the wicked among them follow their wicked."
Technical note / Defect ('illah): Muhammad bin Jabir (Ibn Sayyar al-Suhaymi) is a weak narrator.
وأخرجه معمر في "جامعه" (19903) عن ليث بن أبي سليم، قال: وقال علي: الأئمة من قريش، فمؤمن الناس تبع لمؤمنهم، وكافر الناس تبع لكافرهم. وليث سيئ الحفظ، وروايته عن علي منقطعة.
Technical note / Defect ('illah): Ma'mar reported the saying of Ali in "al-Jami'" (19903) from Layth bin Abi Sulaym. Layth is "of poor memory" (sayyi' al-hifz), and his narration from Ali is "munqati'" (broken in the middle).
وأخرجه نعيم بن حماد في "الفتن" (287) عن هشيم، عن العوام بن حوشب، عمَّن حدثه عن علي، قال: الأئمة من قريش، خيارهم على خيارهم، وشرارهم على شرارهم، ألا وليس بعد قريش إلَّا الجاهلية. وإسناده ضعيف لإبهام راويه عن علي.
Grading: Its chain is "da'if" (weak).
Technical note / Defect ('illah): The reason is that the narrator who narrates from Ali is "unnamed" (mubham).
وأخرج أبو يعلى (564)، والطبراني في "الدعاء" (2116) من طريق حفص بن خالد، قال: حدثني أبي، عن جدي، عن عليّ: أن رسول الله ﷺ خطب الناس ذات يوم فقال: "إنّ الأمراء من قريش - ثلاث مرار - ما أقاموا ثلاثًا: ما حكموا فعدلوا، وما عاهدوا فوفوا، وما استُرحموا فرحموا، فمن لم يفعل ذلك منهم، فعليه لعنة الله والملائكة والناس أجمعين". وفي إسناده غيرُ واحد مجهول، لكن صحَّ معناه عن غير ما صحابيٍّ كما سيأتي ذكرهم.
Reference / Source: Abu Ya'la (564) and al-Tabarani in "al-Du'a'" (2116) narrated it by way of Hafs bin Khalid that the Messenger of Allah (peace and blessings be upon him) said: "The rulers are from Quraysh (he said it three times) as long as they do three things: they judge with justice, fulfil their covenants and show mercy."
Technical note / Defect ('illah): In its chain there is more than one "majhul" narrator; however, its meaning is established by authentic narrations from other Companions, as will be mentioned below.
وقوله: "الأئمة من قريش" قال الحافظ ابن حجر في "الفتح" 11/ 58: جمعتُ طرقه عن نحو أربعين صحابيًا.
Important point: Al-Hafiz Ibn Hajar (may Allah have mercy on him) said in "Fath al-Bari" 11/ 58 that he collected the routes of the narration with the words "The imams are from Quraysh" from about forty (40) Companions.
قلنا: منها حديث أبي هريرة عند البخاري (3495)، ومسلم (1818) بلفظ: "الناس تبع لقريش في هذا الشأن، مسلمهم تبع لمسلمهم، وكافرهم تبع لكافرهم".
Corroborating chains and supporting reports: One of them is the narration of Abu Hurayrah in al-Bukhari (3495) and Muslim (1818) with these words: "In this matter (of rule) the people follow Quraysh: their Muslims follow their Muslims, and their disbelievers follow their disbelievers."
ومنها حديث ابن عمر عند البخاري (3501)، ومسلم (1820) بلفظ: "لا يزال هذا الأمر في قريش ما بقي منهم اثنان".
Corroborating chains and supporting reports: The narration of Ibn Umar in al-Bukhari (3501) and Muslim (1820) has these words: "This matter (the caliphate) will remain with Quraysh as long as even two of them remain."
وفي باب السمع والطاعة عن أنس بن مالك عند البخاري (693) وغيره بلفظ: "اسمعوا وأطيعوا وإن استُعمل حبشي كأن رأسه زبيبة".
General principle: On the topic of hearing and obeying, the narration of Anas in al-Bukhari (693) states: "Listen and obey, even if an Abyssinian whose head is like a raisin is appointed over you."
وعن أبي ذر عند مسلم (648) بلفظ: إنَّ خليلي أوصاني أن أسمع وأطيع، وإن كان عبدًا مجدَّع الأطراف.
General principle: From Abu Dharr it is narrated in Sahih Muslim (648): "My close friend (peace and blessings be upon him) advised me to listen and obey, even if it be a slave with mutilated limbs."
وقوله فيه: "اسمعوا وأطيعوا ما لم يُخيّر أحدكم بن إسلامه وضربه عنقه … إلخ" منكر، والطاعة مشروطة للحاكم المسلم وفيما لا معصية فيه، لقوله ﷺ في حديث أم الحصين عند أحمد 45/ (27269)، ومسلم (1838): "ولو استُعمل عليكم عبد يقودكم بكتاب الله، فاسمعوا له وأطيعوا".
Technical note / Defect ('illah): The words in this hadith, "Obey as long as it does not come to a choice between Islam and being killed", are munkar.
Important point: The Shari'ah principle is that obedience is due to a Muslim ruler and only in matters that are not sinful, as in the narration of Umm al-Husayn (Muslim 1838): "As long as he leads you by the Book of Allah, listen to him and obey."
ولقوله ﷺ في حديث أنس عند أحمد 19/ (12307)، والحاكم (8738)، وفي حديث أبي برزة عند أحمد 23/ (19777)، وفي حديث أبي موسى الأشعري عند أحمد أيضًا 32/ (19541): "الأئمة من قريش، إنَّ لهم عليكم حقًّا، ولكم عليهم حقًّا مثل ذلك، ما إن استُرحموا فرحموا، وإن عاهدوا وفوا، وإن حكموا عدلوا، فمن لم يفعل ذلك منهم، فعليه لعنة الله والملائكة والناس أجمعين". ونحوه من حديث أبي هريرة عند أحمد أيضًا 13/ (7653).
Reference / Source: In the hadiths narrated from Anas, Abu Barzah and Abu Musa al-Ash'ari (may Allah be pleased with them) (Musnad Ahmad 19/ 12307, 23/ 19777, 32/ 19541; and al-Hakim (8738) for the hadith of Anas): "The imams are from Quraysh. They have a right over you, and you have a similar right over them, as long as they show mercy when mercy is sought, fulfil their covenants and judge with justice; whoever of them does not do so, upon him is the curse of Allah, the angels and all the people." Similar to it is the hadith of Abu Hurayrah, also with Ahmad 13/ (7653).
