أخبرنا أبو العبّاس المحبوبي، حدثنا أحمد بن سيَّار، حدثنا عَبْدان، عن أبي حمزة، عن المغيرة الأزدي، عن محمد بن زيد، عن حيَّان الأعرج، عن العلاء ابن الحضرمي قال: بعثني رسولُ الله ﷺ في الخليطَينِ يكون أحدُهما مسلم والآخرُ مشرك (1)، أن خُذْ (2) من المسلم العُشرَ، ومن المُشرك الجِزْيةَ (3). It is narrated from Sayyiduna al-Ala' bin al-Hadrami (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) sent me (as an official) to mixed people, some of whom were Muslims and some polytheists, and he (peace and blessings be upon him) ordered that I collect the tithe ('ushr, one tenth) from the Muslim and the jizyah from the polytheist.

(1) كذا في النسخ الخطية، وحقه نصب كلمة مسلم ومشرك، وكلمة "يكون" لم ترد في "المعجم الكبير". Technical note / Defect ('illah): It is like this in the manuscripts, but grammatically the words "muslim" and "mushrik" should have been in the accusative (mansub). Also, the word "yakun" is not found in al-Tabarani's "al-Mu'jam al-Kabir".
(2) في (ص): آخذ. Note / Clarification: In manuscript (S) the word at this place is "akhidh" (one who takes).
(3) إسناده ضعيف، المغيرة الأزدي مجهول، قال المزي في "التهذيب" 28/ 408: أظنه المغيرة ابن مسلم القسملي، فإنَّ القسامل من الأزد. ومحمد بن زيد أيضًا مجهول، وحيان الأعرج وثقه ابن معين، لكن روايته عن العلاء منقطعة. Grading: Its chain is weak. Technical note / Defect ('illah): al-Mughirah al-Azdi is "majhul" (unknown); Imam al-Mizzi said in "al-Tahdhib" (28/ 408): "I think he is al-Mughirah bin Muslim al-Qasmali, for the Qasamil are of al-Azd." Muhammad bin Zayd is also majhul, and Hayyan al-A'raj, although Ibn Ma'in declared him thiqah, his narration from al-'Ala' is "munqati'" (broken). عبدان: هو عبد الله بن عثمان بن جبلة، وأبو حمزة: هو السكري محمد بن ميمون المروزي. Important point: 'Abdan is 'Abd Allah bin 'Uthman bin Jabalah, and Abu Hamzah is al-Sukkari, Muhammad bin Maymun al-Marwazi. وأخرجه أحمد 34/ (20527)، وابن ماجه (1831) من طرق عن عتاب بن زياد بهذا الإسناد. لكن بلفظ: الخراج، مكان الجِزية. Reference / Source: Imam Ahmad (34/ 20527) and Ibn Majah (1831) narrated it through various routes from 'Attab bin Ziyad with this same chain, but with the word "al-kharaj" (land tax) in place of "al-jizyah". ورواه عبد الله بن عبد الرحمن الدارمي -فيما ذكر ابن منده في "الصحابة" ص 414 - عن مروان ابن محمد الطاطري، عن بكير بن معروف، عن محمد بن زيد الخراساني، عن حيان الأعرج مرسلًا. لكن قال عقبه: وهو وهم، وصوَّب روايةَ أبي حمزة السكري، مع أنَّ إسنادها إلى محمد ابن زيد أصحُّ من طريق أبي حمزة السكري التي فيها المغيرة المجهول! إلَّا أن يقصد تخطئة من جعله صحابيًا، فنعم. Technical note / Defect ('illah): 'Abd Allah bin 'Abd al-Rahman al-Darimi narrated it, according to what Ibn Mandah mentioned in "al-Sahabah" (p. 414), from Marwan bin Muhammad al-Tatari, from Bukayr bin Ma'ruf, from Muhammad bin Zayd al-Khurasani, from Hayyan al-A'raj as "mursal". But he (Ibn Mandah) said after it: "It is an error", and declared the narration of Abu Hamzah al-Sukkari to be correct, even though its chain up to Muhammad bin Zayd is sounder than the route of Abu Hamzah al-Sukkari, in which is the unknown al-Mughirah! Unless he meant to show the error of whoever made him (Hayyan) a Companion, in which case, yes.
