Mustadrak al-Hakim — Hadith 6805

أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني الحافظ، حدثنا يحيى بن محمد بن يحيى، حدثنا مُسدَّد، حدثنا يحيى بن سعيد، عن ابن جُريج، عن محمد ابن يوسف مولى عثمان، أنه سمع عبدَ الله بن عمرو بن عثمان يُخبر: أنه سمع أبا حبَّة البَدْري يُفتي الناسَ: أنه لا بأسَ بما رَمَى الرجلُ في الجِمار من الحصَى، قال: عبد الله ابن عمرو بن عثمان: فذكرتُ ذلك لعبد الله بن عمر، فقال: صدَقَ أبو حبَّة. وكان أبو حَبَّة بدريًا (1).

It is narrated from Abdullah bin Amr bin Uthman that he heard Abu Habbah al-Badri (may Allah be pleased with him) giving the people a ruling that there is no harm in picking up (fallen) pebbles at the Jamarat and throwing them. Abdullah bin Amr bin Uthman said: I mentioned this to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), and he said: "Abu Habbah has spoken the truth." And Abu Habbah was a Companion who took part in Badr.

(1) إسناده صحيح، وابن جريج قد صرَّح بسماعه من محمد بن يوسف عند غير المصنف، فانتفت شبهة تدليسه. ومع تصريح عبد الله بن عمرو بن عثمان بسماعه من أبي حبة إلَّا أنَّ الحافظ ابن حجر قال في "الإصابة" 7/ 83: وسنده قوي إلَّا أنَّ عبد الله بن عَمرو بن عثمان لم يدركه. قلنا: أبو حبة راوي هذا الحديث الظاهر أنه صحابي تأخرت وفاته، وهو غير أبي حبة الذي استشهد في أحد، يدل على ذلك عدة أمور: أولها: حديث المصنف هذا حيث صرح فيه عبد الله بن عمرو بن عثمان بسماعه من أبي حبة، وعبد الله بن عمرو توفي سنة 96.
Grading: Its chain is sahih.
Technical note / Defect ('illah): Ibn Jurayj explicitly stated that he heard from Muhammad bin Yusuf in sources other than the author's, which removes the suspicion of his tadlis. Although 'Abd Allah bin 'Amr bin 'Uthman explicitly states that he heard from Abu Habbah, al-Hafiz Ibn Hajar said in "al-Isabah" (7/ 83): "Its chain is strong, except that 'Abd Allah bin 'Amr bin 'Uthman did not meet him." Our position, however, is that Abu Habbah, the narrator of this hadith, appears to be a Companion who died late, and he is someone other than the Abu Habbah who was martyred at the Battle of Uhud. Several things indicate this. The first is this hadith of the author itself, in which 'Abd Allah bin 'Amr bin 'Uthman (d. 96 AH) explicitly states that he heard from Abu Habbah.
ثانيها: الحديث الذي أورده المصنف بعد هذا الحديث، وفيه تصريح أبي بكر بن محمد بن عمرو بن حزم بسماعه من أبي حبة، وابن حزم تأخرت وفاته إلى سنة 120، لذلك أخرجه صاحبا "الصحيحين" كما سيأتي.
Important point: The second is the hadith that the author cites after this one, in which Abu Bakr bin Muhammad bin 'Amr bin Hazm (who lived until 120 AH) explicitly states that he heard from Abu Habbah; for this reason the two authors of the "Sahihs" (al-Bukhari and Muslim) transmitted it, as will come.
ثالثها: ما رواه ابن أبي شيبة 10/ 520، وأحمد 25/ (16001) عن عفان عن حماد بن سلمة عن علي بن زيد عن عمار بن أبي عمار قال: سمعت أبا حبة البدري قال: لما نزلت: ﴿لَمْ يَكُنِ الَّذِينَ كَفَرُوا مِنْ أَهْلِ الْكِتَابِ﴾ فذكر الحديث. وعمار بن أبي عمار تأخرت وفاته إلى ما بعد 120.
Corroborating chains and supporting reports: The third is what Ibn Abi Shaybah (10/ 520) and Ahmad (25/ 16001) narrated from 'Affan, from Hammad bin Salamah, from 'Ali bin Zayd, from 'Ammar bin Abi 'Ammar, who said: I heard Abu Habbah al-Badri say: When "Lam yakuni alladhina kafaru min ahl al-kitab" (Those who disbelieved among the People of the Book were not, al-Bayyinah 98: 1) was revealed, and he mentioned the hadith. 'Ammar bin Abi 'Ammar lived until after 120 AH.
فهذه الأحاديث التي صرَّح فيها هؤلاء التابعون المتأخرة وفاتهم بسماعهم من أبي حبة تدل على أنه صحابي آخر غير الذي استُشهد في أحد. وإليه ذهب الواقدي في "مغازيه" فقد نقل الحافظ ابن حجر في "التقريب" عنه: أنَّ الذي شهد بدرًا واستُشهد بأحد هو غير أبي حبة الذي روى حديث الإسراء وحديث ﴿لَمْ يَكُنِ﴾، وروى عنه ابنُ حزم وعمارُ بن أبي عمار، فإنَّ شيخ عمار بقي إلى خلافة معاوية لتصريح عمار بالسماع منه، والله أعلم.
General principle: These statements of late Successors, who explicitly state that they heard from Abu Habbah, show that he is a different Companion, not the one who was martyred at Uhud. al-Waqidi took this view in his "Maghazi": al-Hafiz Ibn Hajar quoted him in "al-Taqrib" as saying that the Abu Habbah who took part in Badr and was martyred at Uhud is different from the Abu Habbah who narrated the hadith of the Isra' (Night Journey) and the hadith of "Lam yakun", from whom Ibn Hazm and 'Ammar bin Abi 'Ammar narrated; for 'Ammar's shaykh lived until the caliphate of Mu'awiyah (may Allah be pleased with him), given 'Ammar's explicit statement that he heard from him. And Allah knows best.
وأخرجه الطبراني في "المعجم الكبير" 22/ (820) عن معاذ بن المثنى، عن مسدد بن مسرهد، بهذا الإسناد.
Reference / Source: al-Tabarani narrated it in "al-Mu'jam al-Kabir" (22/ 820) from Mu'adh bin al-Muthanna, from Musaddad bin Musarhad, with this same chain.
وأخرجه الفاكهي في "أخبار مكة" 4/ 297، والطحاوي في "شرح مشكل الآثار" 9/ 129 - 130، وابن منده في "معرفة الصحابة" ص 836 من طرق عن ابن جريج قال: أخبرني محمد بن يوسف، به.
Reference / Source: al-Fakihi in "Akhbar Makkah" (4/ 297), al-Tahawi in "Sharh Mushkil al-Athar" (9/ 129 - 130) and Ibn Mandah in "Ma'rifat al-Sahabah" (p. 836) narrated it through various routes from Ibn Jurayj, who said: Muhammad bin Yusuf informed me.
