Mustadrak al-Hakim — Hadith 6763

حدثنا علي بن حَمْشاذ العَدْل، حدثنا إسماعيل بن إسحاق القاضي وزياد بن الخليل التُّستَري، قالا: حدثنا إبراهيم بن المنذر الحِزامي، حدثنا عبد العزيز ابن أبي حازم، عن يزيد بن عبد الله بن الهاد، عن محمد بن إبراهيم التَّيمي، عن عيسى بن طلحة بن عُبيد الله، عن عُمير بن سَلَمة الضَّمْري قال: بينما نحن نسيرُ معَ رسولِ الله ﷺ وهو مُحرِمٌ ببعض نواحي الرَّوحاء، إذا نحن بحمارٍ معقور، فذكرتُ ذلك للنبيِّ ﷺ فقال: "دَعُوه"، فأتاه صاحبُه الذي عقرَه، وهو رجل من بَهْز، فقال: يا رسولَ الله، شأنَكم بهذا الحمارِ، فأمر رسولُ الله ﷺ أبا بكر أن يَقسِمَه بين الرِّفاق، ثم مرَّ فلمَّا كان بالأُثاية مرَّ بظَبْي حاقفٍ في ظلِّ شجرةٍ فيه سهمٌ، فأمرَ النبيُّ ﷺ إنسانًا فنادَى: أن لا يأخُذَه إنسانٌ، فنَفَذَ الناسُ وتركوه (1). ذكرُ أبي الجَعْد الضَّمْري ﵁-

It is narrated from Sayyiduna Umayr bin Salamah al-Damri (may Allah be pleased with him) that: While we were travelling with the Messenger of Allah (peace and blessings be upon him) in the state of ihram through one of the areas of al-Rawha', we came upon a wounded wild ass. I mentioned it to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Leave it." Then its owner, a man from the tribe of Bahz, came and said: "O Messenger of Allah! This wild ass is yours to deal with." So the Messenger of Allah (peace and blessings be upon him) ordered Sayyiduna Abu Bakr (may Allah be pleased with him) to distribute it among the travellers. Then he (peace and blessings be upon him) went on until, at al-Uthayah, he passed by a deer lying curled up in the shade of a tree with an arrow in it. The Prophet (peace and blessings be upon him) ordered a man, who called out and announced that no one should take it. So the people passed by and left it where it was.

Grading: According to al-Dhahabi, its chain is "sahih".
وأخرجه مختصرًا النسائي (4837)، وابن حبان (5112) من طريق بكر بن مضر، عن يزيد ابن عبد الله بن الهاد بهذا الإسناد.
Reference / Source: Imam al-Nasa'i and Ibn Hibban recorded it in abridged form via Bakr bin Mudar.
وأخرجه بتمامه أحمد 24/ (15450) عن هشيم، عن يحيى بن سعيد الأنصاري، عن محمد ابن إبراهيم التيمي، به.
Reference / Source: Imam Ahmad recorded it in full (24/ 15450) with the chain Hushaym from Yahya al-Ansari.
وخالف هشيمًا مالكٌ في "الموطأ" 1/ 351 - ومن طريقه النسائي (3786)، وابن حبان (5111) - ويزيدُ بن هارون عند أحمد 25/ (15744)، فروياه (مالك ويزيد) عن يحيى الأنصاري، به عن عمير بن سلمة، عن الرجل البَهْزي. فجعلاه من مسند البهزي، واسمه زيد بن كعب. وانظر لهذا الخلاف "علل الدارقطني" (3182) فقد استوعبها. وهذا من الاختلاف الذي لا يضرُّ، لأنَّ الصحابة كلهم ثقات عدول.
Technical note / Defect ('illah): Imam Malik and Yazid bin Harun contradicted Hushaym in this narration: they made it narrated via "Umayr bin Salamah" from "al-Bahzi" (Zayd bin Ka'b), i.e. they placed it in the Musnad of al-Bahzi.
Important point: Imam al-Daraqutni set out this disagreement in detail in "al-Ilal". However, this is a disagreement that does not harm the authenticity of the hadith, because all the Companions are trustworthy and upright.
قوله: "معقور"، يقال: عَقَر البعيرَ والفرس بالسيف فانْعَقَر، أي: ضرب به قوائمه.
Note / Clarification: The word "ma'qur" means an animal (camel or horse) whose legs have been struck with a sword to bring it down.
وقوله: "حاقف" أي: نائم قد انحنى في نومه.
Note / Clarification: The word "haqif" means (an animal) sleeping in such a way that its body is bent or curled up in sleep.
