Mustadrak al-Hakim — Hadith 6732

أخبرَناه أبو بكر محمد بن عبد الله الحَفيد، حدثنا علي بن الحسين بن الجُنيد، حدثنا سليمان بن داود الشَّاذَكوني، حدثنا إسماعيل بن عبيد الله، حدثنا عثمان بن عبد الله (2) بن مَوْهَب، عن جابر بن سَمُرة، عن أبيه سَمُرة بن عمرو (3) السُّوَائي قال: سألتُ رسولَ الله ﷺ فقلت: إنَّا أهلُ باديةٍ وماشية، فهل نتوضَّأُ من لحوم الإبلِ وألبانِها؟ قال: "نعم" فقلت: نتوضَّأ من لحومِ الغَنم وألبانِها؟ قال: "لا" (1) ذكرُ أبي جُحَيفة السُّوَائي ﵁-
Sayyiduna Jabir bin Samurah (may Allah be pleased with him) narrates from his father, Sayyiduna Samurah bin Amr al-Suwa'i (may Allah be pleased with him), that: I asked the Messenger of Allah (peace and blessings be upon him): "We are people who live far from the towns and raise livestock; should we perform ablution (again) after eating camel meat and drinking its milk?" He (peace and blessings be upon him) said: "Yes (perform ablution)." I said: "Should we also perform ablution after eating the meat of sheep and drinking their milk?" He (peace and blessings be upon him) said: "No."

Technical note / Defect ('illah): In manuscript (M) this name was corrupted to "Ubayd Allah", while manuscript (S) does not mention it at all.

(3) تحرَّف في النسخ الخطية إلى: جابر.
Note / Clarification: In the manuscripts there is a corruption (scribal error) here, to the word "Jabir".

(1) إسناده تالف؛ سليمان بن داود الشاذكوني متهم بالكذب، وشيخه إسماعيل بن عبيد الله لم نتبينه. عثمان بن موهب: هو عثمان بن عبد الله بن موهب المدني.
Grading: Its chain is extremely weak and talif (unreliable).
Technical note / Defect ('illah): The narrator in the chain Sulayman bin Dawud al-Shadhakuni is accused of lying, and the condition of his teacher Isma'il bin Ubayd Allah could not be ascertained.
Note / Clarification: Uthman bin Mawhab is Uthman bin Abd Allah bin Mawhab al-Madani.
وأخرجه الطبراني في "الكبير" (7106) ـ وعنه أبو نعيم في "معرفة الصحابة" (3571) -عن إبراهيم بن محمد بن الحارث المعروف بابن نائلة، عن سليمان الشاذكوني، بهذا الإسناد.
Reference / Source: Imam al-Tabarani recorded it in "al-Mu'jam al-Kabir" (7106), and through him Abu Nu'aym in "Ma'rifat al-Sahabah" (3571), via Ibrahim bin Muhammad bin al-Harith (known as Ibn Na'ilah) from Sulayman al-Shadhakuni, with this same chain.
وقد روى هذا الحديث أحمد 34/ (20925)، ومسلم (360)، وابن حبان (1124) و (1154) من طريقين عن عثمان بن عبد الله بن موهب، عن جعفر بن أبي ثور، عن جابر بن سمرة، لا عن أبيه سمرة. وهذا هو المحفوظ. واقتصر فيه على الأمر بالوضوء من لحوم الإبل، ولم يذكر ألبانها.
Details of the narration: This hadith was narrated by Imam Ahmad (34/20925), Imam Muslim (360) and Ibn Hibban (1124) and (1154) through two different routes via Uthman bin Abd Allah bin Mawhab, from Ja'far bin Abi Thawr, from Jabir bin Samurah (may Allah be pleased with him), not from his father Samurah.
Important point: This is the "mahfuz" (preserved, correct) narration, and it mentions only wudu' after eating camel meat, not after drinking camel milk.
قال ابن قدامة في "المغني" 1/ 254: وفي شرب لبن الإبل روايتان:
Reference / Source: Ibn Qudamah says in "al-Mughni" (1/254) that there are two reports (from Imam Ahmad) on whether drinking camel milk breaks wudu':
إحداهما ينقض الوضوء؛ لما روى أسيد بن حضير أنَّ النبيَّ ﷺ قال: "توضَّؤوا من لحوم الإبل وألبانها" رواه الإمام أحمد في "المسند" [برقم (19097)، وسنده ضعيف] وفي لفظ [وهي رواية أحمد نفسها]: أنَّ النبي ﷺ سئل عن ألبان الإبل، فقال: "توضئوا من ألبانها" وسئل عن ألبان الغنم، فقال: "لا تتوضؤوا من ألبانها". رواه ابن ماجه [برقم (496) وسنده ضعيف]، وروي نحوه عن عبد الله بن عمر [موقوفًا عند ابن ماجه (497) وسنده ضعيف أيضًا].
Grading: According to the first report, wudu' is broken.
Note / Clarification: Usayd bin Hudayr (may Allah be pleased with him) narrated that the Prophet (peace and blessings be upon him) said: "Perform wudu' after (eating) camel meat and (drinking) its milk."
Reference / Source: Imam Ahmad recorded it in "al-Musnad" (19097), and its chain is weak. In another wording, which is Imam Ahmad's own narration, the Prophet (peace and blessings be upon him) was asked about camel milk and said: "Perform wudu' from it," and he was asked about sheep milk and said: "Do not perform wudu' from it."
Reference / Source: Ibn Majah recorded it (496), and its chain is weak. A similar narration is reported mawquf from Abd Allah bin Umar (may Allah be pleased with them both) in Ibn Majah (497), whose chain is also weak.
والثانية، لا وضوء فيه؛ لأنَّ الحديث الصحيح إنما ورد في اللحم.
Important point: The second report is that drinking milk does not require wudu', because the sahih hadith came only regarding meat.
ثم قال: وفيما سوى اللحم من أجزاء البعير من كبده وطحاله وسنامه ودهنه ومرقه وكرشه ومصرانه، وجهان:
General principle: Ibn Qudamah further says that regarding the parts of the camel other than its meat, such as the liver, spleen, hump, fat, broth, tripe and intestines, there are two scholarly views (wujuh):
أحدهما: لا ينقض؛ لأنَّ النصَّ لم يتناوله.
Important point: The first view is that they do not break wudu', because the explicit text does not cover these parts.
والثاني: ينقض؛ لأنه من جملة الجزور.
Important point: The second view is that wudu' is broken, because all these things are also part of the "camel" as a whole.
وإطلاق اللحم في الحيوان يراد به جملته؛ لأنه أكثر ما فيه، ولذلك لما حرم الله تعالى لحم الخنزير، كان تحريمًا لجملته، كذا ها هنا.
General principle: When the word "meat" is used with reference to an animal, the whole animal is meant, because meat forms most of it. That is why, when Allah the Exalted forbade "the flesh of swine", the whole swine was meant to be forbidden; the same rule applies here.
