(2) حديث منكر، نعيم بن حماد صاحب مناكير، وقد عُدَّ هذا الحديث من منكراته، فقد ذكر أبو زرعة الدمشقي في "تاريخه" ص 622 أنه سأل دحيمًا عبد الرحمن بن إبراهيم محدِّث الشام عن حديث نعيم هذا فردَّه، وقال: هذا حديث صفوان بن عمرو حديث معاوية (أي: أنَّ حديث عوف هذا رواه صفوان بن عمرو كحديث معاوية في افتراق الأمة) وسيأتي التنبيه عليه لاحقًا، ثم ذكر أبو زرعة أنه سأل يحيى بن معين عن صحته فأنكره، فسأله: من أين يُؤتى؟ فقال: شُبِّه له. وقال ابن معين مرة أخرى كما في "تاريخ بغداد" 15/ 421: لا أصل له. وممن أنكره أيضًا ابن عدي وعبد الغني بن سعيد الحافظ والبيهقي وابن عبد البر، واعتبروا كلَّ من رواه عن عيسى بن يونس غير نعيم، فإنما أخذه من نعيم، وأنه هو الذي تفرَّد به، والله تعالى أعلم.
Grading: This is a "munkar" narration; the narrator Nu'aym bin Hammad is known for narrating munkar reports, and this hadith is counted among his munkar narrations.
Technical note / Defect ('illah): Abu Zur'ah al-Dimashqi, in his "Tarikh" (p. 622), asked the hadith scholar of Syria "Duhaym" ('Abd al-Rahman bin Ibrahim) about it, and he rejected it. Yahya bin Ma'in also declared it munkar and said that it has no basis (asl) ("Tarikh Baghdad" 15/ 421). Among those who also rejected it are Ibn 'Adi, 'Abd al-Ghani bin Sa'id al-Hafiz, al-Bayhaqi and Ibn 'Abd al-Barr; according to them Nu'aym bin Hammad is alone in this narration, and anyone else who transmitted it from 'Isa bin Yunus only took it from Nu'aym.
وأخرجه الطبراني في "الكبير" 18/ (90)، وفي "مسند الشاميين" (1072)، ومن طريقه الخطيب في "الفقيه والمتفقه" (473)، وابن عساكر في "تاريخ دمشق" 62/ 151 عن يحيى بن عثمان بن صالح، بهذا الإسناد.
Reference / Source: al-Tabarani narrated it in "al-Kabir" (18/ 90) and "Musnad al-Shamiyyin" (1072). al-Khatib (473) and Ibn 'Asakir (62/ 151) transmitted it through the route of Yahya bin 'Uthman bin Salih, with this same chain.
وأخرجه البزار (2755)، وابن عدي في "الكامل" 7/ 17، وابن بطة في "الإبانة" 1/ 374 و 2/ 621 - 622، وابن عبد البر في "جامع بيان العلم وفضلة" (1673) و (1996) و (1997)، والخطيب في "تاريخ بغداد" 15/ 421 - 422، والبيهقي في "المدخل إلى السنن الكبرى" (207)، والمصنف فيما سيأتي برقم (8530) من طرق عن نعيم بن حماد به. وانفرد ابن عبد البر فزاد في روايته في الموضعين الأخيرين بين نعيم وعيسى عبدَ الله بنَ المبارك! وقال البزار: هذا الحديث لا نعلم أحدًا حدَّث به إلَّا نعيم بن حماد، ولم يتابع عليه.
Corroborating chains and supporting reports: al-Bazzar (2755), Ibn 'Adi in "al-Kamil" (7/ 17), Ibn Battah in "al-Ibanah" (1/ 374 and 2/ 621-622), Ibn 'Abd al-Barr in "Jami' Bayan al-'Ilm wa Fadlih" (1673, 1996, 1997), al-Khatib in "Tarikh Baghdad" (15/ 421-422), al-Bayhaqi in "al-Madkhal ila al-Sunan al-Kubra" (207) and the author (al-Hakim) later at number (8530) narrated it through various routes from Nu'aym bin Hammad. Ibn 'Abd al-Barr, alone, added 'Abd Allah bin al-Mubarak between Nu'aym and 'Isa in his narration. Imam al-Bazzar says: "We do not know of anyone other than Nu'aym bin Hammad who narrated it; he has no corroboration for it."
قلنا: وقد روي من غير وجه عن عيسى بن يونس من طرق لا يخلو واحد منها من مقال واعتبر غير واحد من أهل العلم منهم البيهقي أنَّ مردَّ هذه الطرق إلى نعيم، وأنهم إنما حملوه عنه. وأخرج هذه الطرق عن عيسى بن يونس الخطيبُ البغداديُّ في "تاريخه" 15/ 422 - 424.
Technical note / Defect ('illah): We say: although it is also narrated from 'Isa bin Yunus through other chains, none of those chains is free of criticism. Several scholars, including Imam al-Bayhaqi, hold that all these routes go back to Nu'aym bin Hammad and that people took it from him. al-Khatib al-Baghdadi presented all these routes in his "Tarikh" (15/ 422-424).
وقد ذهب محدِّث الشام عبد الرحمن بن إبراهيم دُحيم - كما في "تاريخ أبي زرعة الدمشقي" 1/ 622 - أنَّ المحفوظ في حديث عوف بن مالك ما رواه صفوان بن عمرو السكسكي مثل حديث معاوية، وكأنه يشير إلى ما رواه صفوان عن راشد بن سعد عن عوف بن مالك عن النبيِّ ﷺ قال: "افترقت اليهود على إحدى وسبعين فرقة، فواحدة في الجنة، وسبعون في النار" إلى أن قال: "والذي نفسي بيده، لتفترقن أمتي على ثلاث وسبعين فرقة، فواحدة في الجنة وثنتان وسبعون في النار" قيل: يا رسول الله، من هم؟ قال: "الجماعة"، أخرجه ابن ماجه (3992). وقد روي نحوه عن معاوية بن أبي سفيان عند أحمد 28/ (16937) وأبي داود (4597).
Grading: The preserved (mahfuz) narration is the one that Safwan bin 'Amr narrated from Rashid bin Sa'd, from 'Awf bin Malik, whose wording is in Ibn Majah (3992): that the Ummah will split into 73 sects, one will be in Paradise and 72 in the Fire; the sect of Paradise is "al-Jama'ah".
Reference / Source: A similar narration is reported from Mu'awiyah bin Abi Sufyan (may Allah be pleased with him) in Musnad Ahmad (28/ 16937) and Abu Dawud (4597).
قال ابن عبد البر: أما ما روي عن السلف في ذم القياس، فهو عندنا قياس على غير أصل، أو قياسُ يُرَدُّ به أصل.
General principle: Ibn 'Abd al-Barr says: "What is reported from the Salaf in condemnation of qiyas (analogy) refers, in our view, to analogy that has no basis (asl), or analogy by which a basic principle (asl) is itself rejected."
