Mustadrak al-Hakim — Hadith 5981

أخبرني محمد بن عبد الرحمن الغِفَاري بمَرُو، حدثنا عَبْدانُ بن محمد الحافظ، سمعتُ أحمد بن سَيّار يقول: الحَكَم بن عَمرو ورافع بن عَمرو وعطيّة (1) ابن عَمرو صَحِبُوا النبيَّ ﷺ، ثم إنَّ معاوية وَلَّى الحكمَ على خُراسان، وكان سببُ وفاتِه أنه دعا على نفسِه وهو بمَرُو في كتابٍ قُرئ عليه وَرَدَ عليه من زِيادٍ وآخرَ من مُعاوية، فاستُجيب دعوتُه ومات بمَرُو، وكان مات قبلَه بُريدةُ الأسلَميُّ، فدُفِنا جميعًا في مَقبُرة جَصِّين (2) بمَرُو مُقابلَ حَمّام أبي حَمْزة السُّكّري قد زُرْتُ قبرَيهِما (3).

It is narrated from Ahmad bin Sayyar that al-Hakam bin Amr, Rafi' bin Amr and Atiyyah bin Amr (may Allah be pleased with them) enjoyed the company of the Prophet (peace and blessings be upon him). Then Mu'awiyah (may Allah be pleased with him) appointed al-Hakam bin Amr governor of Khurasan. The cause of his death was that when he was in Marw, a letter from Ziyad and then (another) from Mu'awiyah (may Allah be pleased with him) reached him; after it was read, he supplicated (for death) upon himself, which was answered, and he died in Marw. Buraydah al-Aslami (may Allah be pleased with him) had died before him, so the two of them were buried in the Jassin cemetery in Marw, opposite the bathhouse of Abu Hamzah al-Sukkari. I have visited the graves of both of them.

(1) تحرَّف في نسخنا الخطية إلى: علية، باللام بدل الطاء. وإنما هو عطية كما في "أسد الغابة" لابن الأثير 3/ 542، وغيره.
Note / Clarification: In our manuscripts this is distorted into "'Ulayyah", with lam instead of ta'. It is in fact "'Atiyyah", as in Ibn al-Athir's "Usd al-Ghabah" (3/ 542) and elsewhere.

(2) تصحف في نسخنا الخطية إلى: حُصين بالحاء المهملة، والتصويب من "الأنساب" للسمعاني نسبة (الجصّيني)، و "الأماكن" للحازمي 1/ 236، وغيرهما.
Note / Clarification: In our manuscripts this is misspelled as "Husayn", with an undotted ha'. The correction (Jusayn) is from al-Sam'ani's "al-Ansab" (under the attribution "al-Jussayni"), al-Hazimi's "al-Amakin" (1/ 236) and others.

(3) قوله في هذه الرواية: مات قبله بُريدة الأسلمي، خطأ؛ لأنَّ بريدة مات سنة اثنتين وستين أو في السنة التي بعدها، والحكم مات سنة خمسين وقيل: إحدى وخمسين، فالحكم أقدم موتًا من بُريدة. وانظر "أنساب السمعاني" نسبة (الغِفاري)، و "سير أعلام النبلاء" للذهبي 2/ 470 و 477.
Important point: His statement in this narration "Buraydah al-Aslami died before him" is a mistake, because Buraydah died in the year 62 or in the year after it, while al-Hakam died in the year 50, or it is said 51; so al-Hakam died earlier than Buraydah. See "Ansab al-Sam'ani" (under the attribution "al-Ghifari") and al-Dhahabi's "Siyar A'lam al-Nubala'" (2/ 470 and 477).

Grading: Its narrators are thiqah, but al-Hasan (Ibn Abi al-Hasan al-Basri) did not state explicitly that he was present at the incident, nor that he heard from al-Hakam bin 'Amr al-Ghifari. Most likely he was not present at the incident, for al-Hasan al-Basri came to Khurasan with al-Rabi' bin Ziyad al-Harithi after the death of al-Hakam bin 'Amr, when Ziyad bin Abi Sufyan appointed al-Rabi' bin Ziyad governor of Khurasan after al-Hakam's death, and al-Hasan al-Basri was al-Rabi''s scribe. Allah knows best. So the report is mursal.
Technical note / Defect ('illah): Abu Ishaq al-Fazari is Ibrahim bin Muhammad bin al-Harith, and Mu'awiyah bin 'Amr is Ibn al-Muhallab al-Azdi.
وروي مثلُه عن عبد الله بن بُريدة الأسلمي عند ابن عدي في "الكامل" 1/ 410، لكن إسناده ضعيف.
Reference / Source: Something similar is narrated from 'Abdullah bin Buraydah al-Aslami in Ibn 'Adi's "al-Kamil" (1/ 410), but its chain is weak.
