Mustadrak al-Hakim — Hadith 5681

أخبرني أبو طاهر محمد بن أحمد الجُوَيني، حدثنا أبو بكر بن رَجاء بن السَّنْدي، حدثنا أبو بكر بن أبي شَيْبة، حدثنا أبو أُسامة، عن هشام بن عُرْوة، عن أبيه (1)، قال: ورثَتْ عاتكةُ بنتُ زيد بن عمرو بن نُفَيلٍ الزُّبَيرَ، وكانت زوجتَه، فبلغَ حِصّتُها من الميراث ثمانين ألفَ دِرهَمٍ، وقالت تَرثيه: غَدَرَ ابن جُرمُوزٍ بفَارسِ بُهْمةٍ … يومَ اللِّقاء وكانَ غيرَ مُعَرِّدِ يا عَمرُو لو نَبَّهتَه لَوجَدْتَه … لا طائشًا رَعِشَ البَنَانِ ولا اليَدِ ثَكِليْكَ أَمُّكَ إن ظَفِرتَ بفارِسٍ … فيما مضى مما يَرُوحُ ويَغْتَدي كم غَمْرةٍ قد خاضَها لم يَثْنِهِ … عنها طِرادُكَ يا ابنَ فَقْع الفَدْفَدِ واللهِ رَبِّك إن قَتَلتَ لَمُسلِمًا … حَلَّت عليكَ عُقُوبةُ المتعمِّدِ (2)

Hisham bin Urwah narrates from his father that he related: Upon the death of Sayyiduna al-Zubayr bin al-Awwam (may Allah be pleased with him), his wife Atikah bint Zayd bin Amr bin Nufayl (may Allah be pleased with her) became his heir, and the amount of inheritance that came to her share reached eighty thousand dirhams. She composed these verses in elegy of Sayyiduna al-Zubayr (may Allah be pleased with him): "Ibn Jurmuz betrayed, on the day of the encounter, a brave horseman who never turned his back. O Amr! Had you alerted him, you would have found him such that neither his fingers nor his hand trembled (that is, he would have stood utterly firm). May your mother weep for you! Did you ever in the past overcome a horseman like him from among those who come and go morning and evening? How many hard battles did he face from which cowards like you could not turn him back! By Allah, who is your Lord! If you have killed a Muslim (unjustly), then the punishment of the deliberate killer has become binding upon you."

(1) سقط عروة من (ص) و (م)، وأشار في هامش (ز) إلى سقوطه في الأصل، وهو ثابت في (ز) و (ب) و"تلخيص المستدرك" للذهبي.
Note / Clarification: (1) "'Urwah" has dropped out of manuscripts (S) and (M), and the margin of manuscript (Z) indicates its omission in the original; but it is present in (Z), (B) and al-Dhahabi's "Talkhis al-Mustadrak".

(2) إسناده فيه لِين من أجل جهالة شيخ المصنف، فإننا لم نقف له على ترجمة، ومن فوقه ثقات.
Grading: (2) Its chain has "lin" (softness, some weakness) because the author's (al-Hakim's) shaykh is unknown, as we have not found a biography of him; those above him are thiqah (trustworthy).
أبو أسامة: هو حماد بن أسامة.
Note / Clarification: Abu Usamah is "Hammad bin Usamah".
وهذا ظاهره يخالف رواية البخاري (3129) من طريق أبي أسامة، عن هشام بن عروة، عن أبيه، عن عبد الله بن الزبير في حديث طويل، وفي آخره: وكان للزبير أربعُ نسوة، ورُفع الثلث، فأصاب كلَّ امرأة ألفُ ألف ومئتا ألف.
Technical note / Defect ('illah): On its face this contradicts the narration of al-Bukhari (3129) via Abu Usamah, from Hisham, from his father, from 'Abdullah bin al-Zubayr, in a long hadith at the end of which is: "Al-Zubayr had four wives, and after the third was set aside each wife received one million two hundred thousand."
لكن جاء في بعض الروايات كما في "الاستيعاب" لابن عبد البر في ترجمة عاتكة ص 924، وفي "النسب" للزبير بن بكار كما في "فتح الباري" للحافظ ابن حجر 9/ 426: أنَّ الثمانين ألف درهم أخذتها عاتكة مُصالحةً، أي: بعد استحقاقها ألف ألف ومئتي ألف، وكان ذلك برضاها، كما نبَّه عليه الحافظُ ابن حجر. البُهْمة: الرجل الشجاع الذي لا يُدرَى من أي يُؤتَى له من شدّة بأسه.
Details of the narration: But it has come in some narrations (as in Ibn 'Abd al-Barr's "al-Isti'ab", in the biography of 'Atikah, p. 924, and in al-Zubayr bin Bakkar's "al-Nasab" as cited in "Fath al-Bari" 9/ 426) that 'Atikah took the eighty thousand (80,000) dirhams "by way of settlement", i.e. after being entitled to one million two hundred thousand, and that was with her consent, as al-Hafiz Ibn Hajar pointed out.
Note / Clarification: "Al-buhmah": a brave man who, because of his great might in battle, it cannot be known from which side he can be attacked.
وقولها: وكان غير مُعرِّد، أي: لا يَعدُو فَزَعًا.
Note / Clarification: Her words "ghayra mu'arrid" mean: he did not run away out of fear.
وقولها: رعش البنان واليد: مرتجف البنان واليد جُبْنًا وضعفًا.
Note / Clarification: Her words "ra'ish al-banan wa al-yad" mean: with fingers and hand trembling out of cowardice and weakness.
وفَقْع الفَدْفَد: الفَقْع هو نوع أبيض من رديء الكَمأة، والفَدْفَد: الأرض المستوية. وفَقْع الفدفد مثَلٌ للذليل.
Note / Clarification: In "faq' al-fadfad", "faq'" is a poor, white kind of truffle (kam'ah), and "fadfad" is level ground. "Faq' al-fadfad" is a proverbial expression for a lowly, abased person.
والغَمْرة: الشِّدّة.
Note / Clarification: "Al-ghamrah" means: hardship, severity.
