(1) إسناده حسن من أجل محمد بن إسحاق. وهو مكرر الحديث السالف برقم (4352).
Grading: Its chain is "hasan" on account of Muhammad bin Ishaq. And it is a repetition of the earlier hadith number (4352).
(1) قصة أبي العاص هذه في تجارته بأموال قريش إلى الشام، وتصدي سرية زيد بن حارثة له إثر رجوعه واغتنام تلك الأموال إنما سمعها ابن إسحاق من عبد الله بن أبي بكر بن محمد بن عمرو بن حزم يرويها مرسلةً كما وقع عن البيهقي في "السنن" 9/ 143 وفي "دلائل النبوة" 4/ 85 عن أبي عبد الله الحاكم بإسناده هذا الذي هنا إلى ابن إسحاق، وزاد فيها ما سيذكره المصنِّف بعد ذلك برقم (5111) من ردّ تلك الأموال إلى أبي العاص وحمله لها إلى مكة وإعادتها لقريش، ثم إعلانه الإسلامَ بعد ذلك، كل ذلك يرويه ابن إسحاق عن عبد الله بن أبي بكر مرسلًا. فبان بذلك أنَّ صنيع المُصنِّف هنا في "المستدرك" من عطفه قصة أبي العاص على قصة زينب لما أرسلت بقلادتها لفداء أبي العاص بعد أسره يوم بدر، وهمٌ منه رحمه الله تعالى، لأنه أوهم أنَّ القصتين مرويتان بالإسناد الموصول نفسه. وقد أشار البيهقي في مواضع من "سننه الكبرى" كما في الموضعين 6/ 322 و 9/ 95 إلى وجود فروقات في رواية الحاكم لبعض أخبار "سيرة ابن إسحاق"، بين كتابه "المستدرك" و"مغازي ابن إسحاق" بروايته عن أبي العباس الأصم عن أحمد بن عبد الجبار العُطاردي عن يونس بن بُكَير عن ابن إسحاق، وهذا يشير إلى أنَّ الحاكم كان ضبطُه لرواية كتاب "مغازي ابن إسحاق" أحسن من ضبطه لهذه الرواية في "المستدرك"، وذلك لأنه من المعلوم أنَّ إملاءه للمستدرك كان بعد أن تقدَّمت سنُّه وكبر، فكان ربما وصل مقطوعًا أو مرسلًا كما حصل معه هنا وفي الروايتين التاليتين أيضًا، والله أعلم.
Details of the narration: Abu al-'As's going to Syria with the trade goods of Quraysh, the expedition (sariyyah) of Zayd bin Harithah intercepting him on his return, and its seizing the goods as booty: Ibn Ishaq heard this whole incident from Abd Allah bin Abi Bakr bin Muhammad bin 'Amr bin Hazm, who narrates it in "mursal" form. This is as al-Bayhaqi narrated it in "al-Sunan" (9/143) and "Dala'il al-Nubuwwah" (4/85) from Abu Abd Allah al-Hakim with this same chain of his (mentioned here) up to Ibn Ishaq. It also contains the addition that the author (al-Hakim) will mention later at number (5111): that the goods were returned to Abu al-'As, that he took them to Makkah, returned them to Quraysh, and then declared his Islam. All of this Ibn Ishaq narrates from Abd Allah bin Abi Bakr in "mursal" form.
Technical note / Defect ('illah): This makes it clear that the author's joining here in "al-Mustadrak" of the story of Abu al-'As (about the trade) onto the story of Zaynab (may Allah be pleased with her) (in which she sent her necklace to ransom Abu al-'As on the day of Badr) is a "wahm" (error) on his part, because it gives the impression that both stories are narrated with the same "mawsul" (connected) chain (whereas the second story is mursal). Imam al-Bayhaqi indicated in several places in "al-Sunan al-Kubra" (such as 6/322 and 9/95) that there are differences between some narrations of "Sirat Ibn Ishaq" as al-Hakim brought them in "al-Mustadrak" and as they are in "Maghazi Ibn Ishaq" (narrated by him from Abu al-'Abbas al-Asamm, from Ahmad bin Abd al-Jabbar, from Yunus bin Bukayr, from Ibn Ishaq). This indicates that al-Hakim's precision in narrating "Maghazi Ibn Ishaq" was better than in this narration in "al-Mustadrak". The reason is that, as is known, he dictated "al-Mustadrak" in the last part of his life, in old age, so he would sometimes make a "maqtu'" or "mursal" narration "mawsul", as happened here and in the next two narrations as well. And Allah knows best.
وقد وقع مثل ما وقع هذا أيضًا في رواية الطبري في "ذَيل المُذيّل" كما في "منتخبه" لعُريب القرطبي المطبوع بأثر "تاريخ الطبري" 11/ 499، وهو وهمٌ كذلك، لأنَّ الطبري نفسه أورد القصتين المشار إليهما في "تاريخه" 2/ 468 - 470 مبيِّنًا فيهما مُفصِّلًا رواية عائشة في قصة زينب وفدائها زوجها أبا العاص يوم بدر عن رواية عبد الله بن أبي بكر المرسلة في قصة أبي العاص، والإسناد في الكتابين إلى ابن إسحاق واحدٌ، فما جاء في "تاريخ الطبري" أولى ممّا وقع في "ذيل المذيَّل"، ولعلَّ ذلك يكون من صنيع عُريب القرطبي لدى انتخابه لكتاب "ذيل المذيَّل" اختصر فأخلَّ، والله تعالى أعلم.
Technical note / Comparison: A similar error also occurred in al-Tabari's narration in "Dhayl al-Mudhayyal" (as found in the selection of 'Arib al-Qurtubi, printed at the end of "Tarikh al-Tabari" 11/499), and this too is a "wahm". The proof is that Imam al-Tabari himself presented these two stories separately in his "Tarikh" (2/468-470), where he clearly distinguished the story of Zaynab paying the ransom, through the narration of 'A'ishah, from the story of Abu al-'As (about the trade), through the "mursal" narration of Abd Allah bin Abi Bakr, even though the chain up to Ibn Ishaq is the same in both books. Therefore what is in "Tarikh al-Tabari" is preferable to what is in "Dhayl al-Mudhayyal". It may be that this was an adjustment by 'Arib al-Qurtubi, who abridged when making his selection from "Dhayl al-Mudhayyal", which disturbed the meaning. And Allah knows best.
وكذلك جاءت القصتان مفصولتين في رواية محمد بن سَلَمة الحَرَّاني عن ابن إسحاق عند الطبراني في "الكبير" 22/ (1050)، وكذا في رواية زياد بن عبد الله البكائي كما في "السيرة النبوية" لابن هشام 1/ 657، لكن ظاهر ما وقع في رواية ابن هشام عن البكائي أن قصة أبي العاص هذه من قول ابن إسحاق نفسه لم يذكر فيها عبد الله بن أبي بكر، وقد ثبت ذكره في رواية غير البكائي، فهو المعتمد.
Details of the narration / Comparison: Likewise, in al-Tabarani's "al-Mu'jam al-Kabir" (22/1050), in the narration of Muhammad bin Salamah al-Harrani from Ibn Ishaq, these two stories (Zaynab's necklace and Abu al-'As's trade) are also presented separately. Similarly, in the narration of Ziyad bin Abd Allah al-Bakka'i in Ibn Hisham's "al-Sirah al-Nabawiyyah" (1/657) they are also separate. However, the apparent sense of Ibn Hisham's narration (from al-Bakka'i) is that this story of Abu al-'As is Ibn Ishaq's own statement (without an intermediary), since he did not mention Abd Allah bin Abi Bakr in it. But the mention of Abd Allah bin Abi Bakr is established in the narration of narrators other than al-Bakka'i, so that (mursal narration) is the reliable one.
لكن ليس في شيء من روايات ابن إسحاق فِقرة: وقيل: إنَّ رسول الله ﷺ كان هو الذي وجَّه السرية للعير، إلى قوله: سنة ستّ من الهجرة، فلم ترد إلّا هنا وفي رواية الطبري في "ذيل المذيَّل".
Technical note / Isolated wording: However, in none of the narrations of Ibn Ishaq is there the passage: "And it has been said that it was the Messenger of Allah (peace and blessings be upon him) who sent the expedition against the caravan ('ir)", up to his words: "in the year 6 AH". This passage occurs only here (with al-Hakim) and in Imam al-Tabari's narration in "Dhayl al-Mudhayyal".
وقد رواها الواقدي في "مغازيه" 2/ 553، وعنه ابن سعد في "الطبقات" 5/ 6 - 7 عن موسى بن محمد بن إبراهيم التيمي، عن أبيه مرسلًا. وقد انفرد به الواقدي عن شيخه موسى بن محمد التيمي، وموسى هذا منكر الحديث لا يُكتب حديثه عند الأئمة.
Grading: Al-Waqidi narrated it in "al-Maghazi" (2/553), and from him Ibn Sa'd in "al-Tabaqat" (5/6-7), from Musa bin Muhammad bin Ibrahim al-Taymi, from his father, in "mursal" form. Al-Waqidi is alone in narrating it from his teacher Musa bin Muhammad al-Taymi, and this Musa is "munkar al-hadith"; the imams of the field do not write down his hadith.
وقد روى قصة خروج أبي العاص في تجارته إلى الشام أيضًا موسى بن عقبة في روايته عن الزهري عند البيهقي في "دلائل النبوة" 4/ 174، وجاء في روايته أنَّ الذين تعرضوا للقافلة هم: أبو بَصير وأبو جَنْدل زمن هدنة الحديبية، خلافًا لرواية الواقدي التي فيها أن سرية زيد بن حارثة التي اعترضت القافلة.
Details of the narration / Variation in the text: The incident of Abu al-'As setting out for Syria for trade was also narrated by Musa bin 'Uqbah in his narration from al-Zuhri (see: al-Bayhaqi's "Dala'il al-Nubuwwah" 4/174). Musa bin 'Uqbah's narration states that those who intercepted the caravan were "Abu Basir and Abu Jandal" (may Allah be pleased with them), and that this was at the time of the truce of al-Hudaybiyah; this is contrary to the narration of al-Waqidi, which says that the caravan was intercepted by the expedition of Zayd bin Harithah (may Allah be pleased with him).
فقولُ الواقدي وابن إسحاق يدلُّ على أن قصة أبي العاص كانت قبل الحُديبية، وإلا فبعد الهُدْنة لم تتعرَّض سرايا رسول الله ﷺ، قريش، وقول موسى بن عقبة أصوب، وأبو العاص إنما أسلم زمن الهُدنة، وقريش إنما انبسطت عيرها إلى الشام زمن الهدنة، وسياق الزهرى للقصة بين ظاهر أنها كانت في زمن الهدنة، كما قال ابن القيّم في "زاد المعاد" 3/ 282 - 283.
Important research / Preference: The statement of al-Waqidi and Ibn Ishaq indicates that the story of Abu al-'As was "before al-Hudaybiyah", since after the truce the expeditions of the Messenger of Allah (peace and blessings be upon him) did not intercept Quraysh. However, the statement of "Musa bin 'Uqbah" is more correct, because Abu al-'As embraced Islam during "the time of the truce", and the caravans of Quraysh also travelled freely to Syria during the time of the truce. Al-Zuhri's account also makes it apparent that this incident was during the time of the truce, as Ibn al-Qayyim said in "Zad al-Ma'ad" (3/282-283).
ومما يؤكد ذلك ما جاء في الرواية التالية عند المصنف من قوله ﷺ لابنته زينب لمّا استجار بها أبو العاص: "لا يخلص إليكِ فإنك لا تَحِلِّين له"، ومعلوم أن تحريم المؤمنات على أزواجهم الكفار لم يكن إلّا بعد هدنة الحديبية لدى نزول سورة الممتحنة.
Technical note / Textual reasoning: This is further supported by what comes in the author's (al-Hakim's) next narration: when Abu al-'As sought protection from Zaynab (may Allah be pleased with her), the Prophet (peace and blessings be upon him) said to his daughter: "Let him not come near you, for you are not lawful for him." And it is known that believing women were made unlawful for their disbelieving husbands only after the truce of al-Hudaybiyah, upon the revelation of "Surat al-Mumtahanah".
وسيأتي عند المصنف بعده تمام قصة استجارة أبي العاص بزينب وقبول النبي ﷺ لجوارها، وهي قصة صحيحة ثابتة.
Details of the narration: After this, the author presents the complete incident of Abu al-'As seeking the protection of Zaynab and the Prophet (peace and blessings be upon him) accepting her grant of protection, and this story is "sahih and established".
