Mustadrak al-Hakim — Hadith 4684

سمعتُ قاضيَ القضاة أبا الحسن محمد بن صالح الهاشمي يقول: سمعتُ أبا عُمر القاضي يقول: سمعتُ إسماعيل بن إسحاق القاضي يقولُ: وذُكر له قولُ قُثَمَ هذا، فقال: إنما يرثُ الوارثُ بالنسَبِ أو بالولاءِ، ولا خلافَ بين أهل العلم أنَّ ابنَ العمِّ لا يرثُ مع العَمِّ، فقد ظهر بهذا الإجماعِ أن عليًّا ورثَ العلمَ من النبي ﷺ دُونَهم (1). وبصحةِ ما ذكره القاضي:

Isma'il bin Ishaq al-Qadi, commenting on this statement of Qutham bin al-Abbas, said: "An heir inherits only through lineage or through wala' (clientage), and there is no disagreement among the people of knowledge that a paternal cousin does not inherit wealth in the presence of a paternal uncle. So by this consensus it is established that Sayyiduna Ali (may Allah be pleased with him) inherited knowledge from him (peace and blessings be upon him)."

Note / Clarification: (1) Ibn Ma'in too interpreted this report in this sense (inheritance of knowledge), as mentioned in Ibn al-Ushnani's question to him in Ibn Asakir's "Tarikh Dimashq" (42/393).
