Mustadrak al-Hakim — Hadith 4183

حدثنا علي بن عيسى، حدثنا أبو يحيى زكريا بن داود، حدثنا يحيى بن يحيى، أخبرنا عبد الرحمن بن محمد المُحاربي، عن أشعثَ، عن أبي إسحاق، عن مُرّة، عن ابن مسعود، في قوله ﷿: ? ﴿وَدَاوُودَ وَسُلَيْمَانَ إِذْ يَحْكُمَانِ فِي الْحَرْثِ إِذْ نَفَشَتْ فِيهِ غَنَمُ الْقَوْمِ﴾ [الأنبياء: 78]، قال: كَرْمٌ قد أَنبتَتْ عناقيدُه فأفسدَتْه، قال: فقضى داودُ بالغنم لصاحب الكَرْم، فقال سليمان: غيرُ هذا يا نبيَّ الله؟ قال: وما ذاك؟ قال: تدفعُ الكَرْمَ إلى صاحب الغَنَم، فيقومُ عليه حتى يعودَ كما كان، وتدفَعُ الغنمَ إلى صاحبِ الكَرْم فيُصيب منها، حتى إذا كان الكرمُ كما كان، دفعتَ الكَرْمَ إلى صاحبِه، ودفعتَ الغنمَ إلى صاحبِها، قال الله ﷿: ﴿فَفَهَّمْنَاهَا سُلَيْمَانَ وَكُلًّا آتَيْنَا حُكْمًا وَعِلْمًا﴾ (1).

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) concerning this saying of Allah Almighty: "And (remember) Dawud and Sulayman, when they gave judgement concerning the field, when the sheep of the people strayed into it at night" [Surah al-Anbiya: 78]; he said: "It was a vineyard whose clusters had sprouted, and the sheep ruined it." He further said: "So Dawud (peace be upon him) judged that the sheep be given to the owner of the vineyard. Upon this Sulayman (peace be upon him) said: 'O Prophet of Allah! Could there be a judgement other than this?' Dawud (peace be upon him) asked: 'What is that?' Sulayman (peace be upon him) said: 'You should hand the vineyard over to the owner of the sheep so that he tends it until it returns to its former state, and hand the sheep over to the owner of the vineyard so that he benefits from them. Then, when the vineyard has returned to its original state, you return the vineyard to its owner and the sheep to their owner.'" (Concerning this) Allah Almighty says: "So We gave Sulayman understanding of it, and to each of them We gave judgement and knowledge" [Surah al-Anbiya: 79]

(1) إسناده ضعيف لضعف أشعث - وهو ابن سَوّار - وقد أخطأ فيه إذ جعله عن ابن مسعود، وإنما يرويه مُرَّة - وهو ابن شراحيل الهَمْداني - عن مسروق بن الأجدع التابعي، كذلك رواه سفيان الثوري وإسرائيل عن أبي إسحاق السَّبيعي.
Grading: Its chain is da'if (weak) because of the weakness of Ash'ath (Ibn Sawwar).
Technical note / Defect ('illah): Ash'ath made an error in it by making it from Ibn Mas'ud, whereas it is narrated by Murrah (Ibn Sharahil al-Hamdani) from Masruq bin al-Ajda', the Successor (tabi'i). This is how Sufyan al-Thawri and Isra'il narrated it from Abu Ishaq al-Sabi'i.
وأخرجه البيهقي في "السنن" 10/ 118، ومن طريقه ابن عساكر في "تاريخ دمشق" 22/ 234 عن أبي عبد الله الحاكم، بهذا الإسناد.
Reference / Source: It was recorded by al-Bayhaqi in "al-Sunan" 10/ 118, and via him by Ibn Asakir in "Tarikh Dimashq" 22/ 234, from Abu Abd Allah al-Hakim, with this chain.
وأخرجه الطبري في "تفسيره" 17/ 51، وفي "تاريخه" 1/ 486 من طريقين عن عبد الرحمن المحاربي، به.
Reference / Source: It was recorded by al-Tabari in his "Tafsir" 17/ 51 and his "Tarikh" 1/ 486 through two routes from Abd al-Rahman al-Muharibi, with it.
وأخرجه عبد الرزاق في "المصنف" (18433)، وفي "التفسير" 2/ 26، وأبو حذيفة النهدي في "تفسير سفيان الثوري" (645)، والطبري في "تفسيره" 17/ 51 من طريق سفيان الثوري، وآدم بن أبي إياس في "تفسيره" 1/ 413، وابن أبي شَيْبة في "مصنفه" 9/ 436 من طريق إسرائيل بن يونس بن أبي إسحاق السبيعي، وابن أبي حاتم في "تفسيره" كما في "تفسير ابن كثير" 5/ 350 من طريق حُديج بن معاوية، ثلاثتهم عن أبي إسحاق السَّبيعي، عن مُرَّة، عن مسروق قولَه.

Details of the narration: and by Adam bin Abi Iyas in his "Tafsir" 1/ 413 and Ibn Abi Shaybah in his "Musannaf" 9/ 436, via Isra'il bin Yunus bin Abi Ishaq al-Sabi'i; and by Ibn Abi Hatim in his "Tafsir" (as in "Tafsir Ibn Kathir" 5/ 350) via Hudayj bin Mu'awiyah. All three of them (Sufyan, Isra'il and Hudayj) narrate it from Abu Ishaq al-Sabi'i, from Murrah, from Masruq, as his own statement.
