فحدَّثَنا الشيخ أبو بكر أحمد بن إسحاق، حدثنا محمد بن غالب، حدثنا الحسن بن عُمر بن شَقيق، حدثنا سلمة بن الفَضْل، عن محمد بن إسحاق، عن الزُّهْري، عن عُرْوة بن الزُّبَير، قال: بلغ عائشةَ أنَّ أبا هُريرة يقول: إنَّ رسول الله ﷺ قال: "لَأن أُمتِّعَ بسَوطي في سبيل الله، أحبُّ إليَّ مِن أن أُعتق ولدَ الزنى"، وإنَّ رسولَ الله ﷺ قال: "ولدُ الزنى شرُّ الثلاثة، وإنَّ الميتَ يُعذَّب ببُكاء الحيّ". فقالت عائشة: رَحِمَ الله أبا هريرة أساءَ سمعًا وأساء إجابةً: أما قوله: "لأن أُمتِّعَ بسَوطٍ في سبيل الله أحبُّ إليَّ من أن أُعتقَ ولدَ الزنى"، إنها لما نزلت ﴿فَلَا اقْتَحَمَ الْعَقَبَةَ (11) وَمَا أَدْرَاكَ مَا الْعَقَبَةُ﴾ [البلد: 11، 12]، قيل: يا رسول الله، ما عندنا ما نُعتِق إلّا أنَّ أحدَنا له الجاريةُ السوداء تخدُمه وتسعى عليه، فلو أمرناهُنّ فزنَين فجئن بأولادٍ فأعتقناهُم، فقال رسول الله ﷺ: "لَأن أُمتِّعَ بسَوطٍ في سبيل الله، أحبُّ إليَّ من أن آمُرَ بالزنى، ثم أُعتِقَ الولدَ". وأما قوله: "ولدُ الزّنى شرُّ الثلاثة" فلم يكنِ الحديثُ على هذا، إنما كان رجلٌ من المنافقين يؤذي رسولَ الله ﷺ، فقال: "من يَعذِرُني من فلان؟ " قيل: يا رسول الله، إنه مع ما به ولدُ الزنى، فقال رسول الله ﷺ: "هو شرُّ الثلاثةِ"، والله ﷿ يقول: ﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾ [الإسراء: 15]. وأما قوله: "إن الميتَ ليُعذَّبُ ببُكاء الحيّ" فلم يكنِ الحديثُ على هذا، ولكن رسول الله ﷺ مرَّ بدارِ رجلٍ من اليهود قد مات وأهلُه يبكون عليه، فقال: "إنهم يَبكُون عليه، وإنه ليُعذَّبُ"، والله ﷿ يقول: ﴿لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا﴾ [البقرة: 286] (1). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وَأَمَّا قَوْلُهُ: «وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ» فَلَمْ يَكُنِ الْحَدِيثُ عَلَى هَذَا، إِنَّمَا كَانَ رَجُلٌ مِنَ الْمُنَافِقِينَ، يُؤْذِي رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «مَنْ يَعْذِرُنِي مِنْ فُلَانٍ؟» قِيلَ: يَا رَسُولَ اللَّهِ، مَعَ مَا بِهِ وَلَدُ زِنًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «هُوَ شَرُّ الثَّلَاثَةِ» وَاللَّهُ عَزَّ وَجَلَّ يَقُولُ: {وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} [الأنعام: 164]_x000D_
وَأَمَّا قَوْلُهُ: «إِنَّ الْمَيِّتَ لَيُعَذَّبُ بِبُكَاءِ الْحَيِّ» ، فَلَمْ يَكُنِ الْحَدِيثُ عَلَى هَذَا، وَلَكِنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مَرَّ بِدَارِ رَجُلٍ مِنَ الْيَهُودِ قَدْ مَاتَ، وَأَهْلُهُ يَبْكُونَ عَلَيْهِ، فَقَالَ: «إِنَّهُمْ يَبْكُونَ عَلَيْهِ، وَإِنَّهُ لَيُعَذَّبُ» ، وَاللَّهُ عَزَّ وَجَلَّ يَقُولُ: {لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا} [البقرة: 286] «هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ، وَلَمْ يُخَرِّجَاهُ»
It is narrated from Sayyiduna Urwah bin al-Zubayr (may Allah be pleased with him) that it reached the Mother of the Believers, Sayyidah Aishah (may Allah be pleased with her), that Sayyiduna Abu Hurayrah (may Allah be pleased with him) reports that the Messenger of Allah (peace and blessings be upon him) said: "That I should make use of my whip in the path of Allah (that is, wage jihad) is dearer to me than that I should free a child born of fornication (offspring born of illicit relations)," and that the Messenger of Allah (peace and blessings be upon him) said: "The child of fornication is the worst of the three (the father, the mother and himself), and the deceased is punished because of the weeping of the living." At this Sayyidah Aishah (may Allah be pleased with her) said: May Allah Almighty have mercy on Abu Hurayrah; he erred in hearing and he erred in answering (in conveying the matter). As for his saying, "That I should make use of a whip in the path of Allah is dearer to me than freeing a child of fornication," what actually happened is that when these verses were revealed, "But he has not attempted the steep path. And what can make you know what the steep path is?" [Al-Balad: 11, 12], it was said: O Messenger of Allah! We have nothing to free except that one of us has a black slave-girl who serves him; so shall we order them (to commit fornication) so that they bear children, and then we free those children? At this the Messenger of Allah (peace and blessings be upon him) said: "That I should make use of my whip in the path of Allah is dearer to me than that I should order fornication and then free the child." And as for his saying, "The child of fornication is the worst of the three," the hadith was not like this; rather, a man from among the hypocrites used to harm the Messenger of Allah (peace and blessings be upon him), so he (peace and blessings be upon him) said: "Who will excuse me in the matter of so-and-so?" It was said: O Messenger of Allah! Along with his misdeeds, he is also a child of fornication. So the Messenger of Allah (peace and blessings be upon him) said: "He (because of his own deeds) is the worst of the three," whereas Allah, the Mighty and Majestic, says: "And no bearer of burdens will bear the burden of another" [Al-Isra: 15]. And as for the saying, "The deceased is punished because of the weeping of the living," this hadith too was not like this; rather, the Messenger of Allah (peace and blessings be upon him) passed by the house of a Jew who had died while his family were weeping over him, and he (peace and blessings be upon him) said: "These people are weeping over him while he is being punished (because of his disbelief)," whereas Allah, the Mighty and Majestic, says: "Allah does not burden a soul beyond its capacity" [Al-Baqarah: 286].
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده حسن لولا أنَّ فيه عنعنة محمد بن إسحاق، فهو مدلِّس، وسلمة بن الفضل - وهو الأبرش - من أوثق الناس في ابن إسحاق، وروايته للمغازي عنه أتم الروايات كما قال ابن معين. قلنا: فلا عجب إذًا أن لا يذكر هذا الخبرَ غيرُه عن ابن إسحاق، وقال البيهقي في "معرفة السنن والآثار" (20238): قد رُوي عن بُرد بن سنان أبي سليمان الشامي عن الزُّهْري عن عائشة مرسلًا في إعتاق ولد الزنى، فدلَّ على أنَّ الحديث له أصل من حديث الزُّهْري، والله أعلم. Grading: The chain of this hadith would be "hasan" were it not for the "'an'anah" of Muhammad bin Ishaq (as he is a mudallis). Salamah bin al-Fadl (al-Abrash) is the most reliable of Ibn Ishaq's students, especially in the Maghazi (according to Ibn Ma'in). Al-Bayhaqi said that it is also narrated from Burd bin Sinan, from al-Zuhri, from Aishah, as "mursal", which shows that it has a basis in the hadith of al-Zuhri. وأخرجه البيهقي في "السنن الكبرى" 10/ 58، وفي "معرفة السنن" (20235 - 20237) عن أبي عبد الله الحاكم، بهذا الإسناد. Reference / Source: Al-Bayhaqi narrated it in "al-Sunan al-Kubra" (10/ 58) and in "Ma'rifat al-Sunan" (20235-20237) from Abu Abd Allah al-Hakim with this same chain. وأخرجه الطحاوي في "شرح مشكل الآثار" (910) عن صالح بن شعيب بن أبان البصري، ¤ ¤ عن الحسن بن عمر بن شقيق، به. لكن لم يسقه بتمامه. Reference / Source: Al-Tahawi narrated it likewise in "Sharh Mushkil al-Athar" (910) from Salih bin Shu'ayb, from al-Hasan bin Umar bin Shaqiq, but he did not cite it in full. ويشهد للقسم الثاني من الحديث في ردّ عائشة على أبي هريرة في روايته بأنَّ ولد الزنى شر الثلاثة، ما رواه هشام بن عروة، عن أبيه، عن عائشة، كانت إذا قيل لها: هو شرُّ الثلاثة، عابت ذلك، وقالت: ما عليه من وزر أبويه؟ قال الله: ﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾. أخرجه عبد الرزاق (13860) و (13861)، وابن أبي شيبة 2/ 216، وابن أبي داود في "مسند عائشة" (53)، وابن المنذر في "الأوسط" (1938)، وابن أبي حاتم في "تفسيره" 5/ 1435، وغيرهم من طرق عن هشام، وإسناده صحيح. Corroborating chains and supporting reports: The second part of the hadith (Aishah's refutation of Abu Hurayrah that the child of fornication is the worst of the three) is supported by the narration of Hisham bin 'Urwah, from his father, from Aishah: when it was said in her presence that he is "the worst of the three", she disapproved of it and said: "Why should the burden of his parents' sin be upon him? Allah has said: No bearer of burdens shall bear the burden of another." Abd al-Razzaq, Ibn Abi Shaybah and others narrated it, and its chain is "sahih". وروي عنها مرفوعًا كما سيأتي برقم (7230)، لكن الصحيح وقفه كما رواه جماعة أصحاب هشامٍ عنه. Technical note / Defect ('illah): It is also narrated from her as "marfu'" (number 7230), but the correct view is that it is "mawquf", as the group of Hisham's students narrated it. ويشهد للقسم الثالث ما روي عن عائشة أم المؤمنين أنها ردّت في ذلك على عبد الله بن عُمر، كما أخرجه أحمد 9/ (4959) و 40/ (24302)، والبخاري (3978)، ومسلم (929) و (931) و (932)، وغيرهم. Corroborating chains and supporting reports: The third part is supported by the fact that Aishah (may Allah be pleased with her) also refuted Abd Allah bin Umar on this matter, as Ahmad, al-Bukhari and Muslim narrated. وفي رواية عنها أنها ردّت في ذلك على عمر بن الخطاب أيضًا، كما أخرجه أحمد 1/ (288) و 40/ (26409)، والبخاري (1288)، ومسلم (929)، (23)، وغيرهم، وفي بعض هذه الروايات أنَّ عمر هو الذي حدّث ابنَه عبدَ الله بذلك. Corroborating chains and supporting reports: In one narration she also refuted Umar bin al-Khattab (may Allah be pleased with him) (Ahmad, al-Bukhari, Muslim). And in some narrations it is stated that it was Umar who narrated this hadith to his son Abd Allah. قوله: "من يَعذِرني" معناه: من ينصرني عليه، أو من يقوم بعذري إن كافأته على سوء فعله ولا يلومني. Note / Clarification: "Man ya'dhiruni" means: who will help me, or who will accept my excuse (and not blame me) if I punish him for his evil deed.
