Mustadrak al-Hakim — Hadith 1116

حدثنا أبو بكر محمد بن أحمد بن بالَوَيه، حدثنا محمد بن أحمد بن النَّضْر الأزْديّ، حدثنا معاوية بن عمرو، حدثنا زائدة، عن سِمَاك بن حَرْب، عن عِكرِمة، عن ابن عباس، قال: جاء أعرابيٌّ إلى النبي ﷺ فقال: أبصرتُ الهلالَ الليلةَ، فقال: "أتشهدُ أن لا إله إلا الله وأنَّ محمدًا عبدُه ورسولُه؟ "، قال: نعم، قال: "قُمْ يا بلالُ فأذِّن في الناس فلْيصوموا" (1). قد احتجَّ البخاريُّ بعكرمة، واحتج مسلمٌ بسماك، و
هذا حديث صحيح الإسناد متداوَلٌ بين الفقهاء، ولم يُخرجاه.

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: A Bedouin came to the Prophet (peace and blessings be upon him) and said: I have seen the new moon tonight. He (peace and blessings be upon him) asked: "Do you testify that there is no true god except Allah and that Muhammad is His servant and His Messenger?" He said: Yes. He (peace and blessings be upon him) said: "O Bilal! Stand up and announce among the people that they should fast."
Imam Bukhari used Ikrimah as evidence and Imam Muslim used Simak as evidence, and this hadith with a sahih (authentic) chain is current among the jurists, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) حسن لغيره، وهذا إسناد رجاله ثقات إلّا أنَّ سماكًا في بعض رواياته عن عكرمة - وهو مولي ابن عباس - اضطراب، وقد اختلفوا عليه في هذا الحديث فروي عنه عن عكرمة مرسلًا، ورجَّحه غير واحد من الأئمة، لكن له شاهد يتقوى به كما سيأتي بيانه. زائدة: هو ابن قُدامة.
Grading: (1) It is "hasan li-ghayrihi".
Variation in the chain: There is idtirab in the narrations of Simak from Ikrimah; some called it mursal, but due to the supporting reports it becomes strong. Za'idah refers to Ibn Qudamah.
وأخرجه ابن ماجه (1652) من طريق أبي أسامة حماد بن أسامة، عن زائدة بن قدامة، بهذا الإسناد.
Reference / Source: Ibn Majah (1652) narrated it through the chain of Abu Usamah from Za'idah, by this same chain.
وأخرجه أبو داود (2340)، والترمذي (691) من طريق الوليد بن أبي ثور، عن سماك بن حرب، به. قال الترمذي: وروى سفيان الثوري وغيره عن سماك عن عكرمة عن النبي ﷺ مرسلًا، وأكثر أصحاب سماك رووا عن سماك عن عكرمة عن النبي ﷺ مرسلًا.
Reference / Source: Abu Dawud (2340) and al-Tirmidhi (691) narrated it through the chain of al-Walid bin Abi Thawr from Simak. Al-Tirmidhi said that most narrators narrated it as mursal.
ورواية سفيان الثوري المرسلة عند النسائي في "الكبرى" وسيأتي تخريجها عند الحديث رقم (1558)، ورواه أبو داود من طريق حماد بن سلمة عن سماك عن عكرمة مرسلًا، وسيأتي تخريجه عند الحديث (1560).
Reference / Source: The mursal narrations of Sufyan al-Thawri and Hammad bin Salamah will come later at numbers (1558) and (1560).
وسيأتي الحديث أيضًا غير ما ذكرنا برقم (1557) من طريق حسين الجعفي عن زائدة.
Repetition: It will also come later at number (1557) by way of Husayn al-Ju'fi.
وله شاهد من حديث عبد الله بن عمر، سيأتي برقم (1555).
Corroborating chains and supporting reports: The hadith of Abdullah bin Umar (may Allah be pleased with him) (number 1555) is a supporting report (shahid) for it.
قال الترمذي: والعمل على هذا الحديث عند أكثر أهل العلم، قالوا: تُقبَل شهادة رجل واحد في الصيام، وبه يقول ابن المبارك والشافعي وأحمد وأهل الكوفة، قال إسحاق: لا يصام إلّا بشهادة رجلين، ولم يختلف أهل العلم في الإفطار أنه لا يقبل فيه إلّا شهادة رجلين.
General principle: Imam al-Tirmidhi says that most of the people of knowledge act upon this: for fasting (sighting the moon) the testimony of one upright person suffices, but for Eid (ending the fast) two witnesses are required.
