Musnad Ahmad 16598 — Hadith of a person from the Ansar
(حديث مرفوع) حَدَّثَنَا حَجَّاجٌ ، قَالَ : حَدَّثَنَا لَيْثٌ ، قَالَ : حَدَّثَنِي عُقَيْلٌ ، عَنِ ابْنِ شِهَابٍ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، وَسُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ إِنْسَانٍ مِنَ الْأَنْصَارِ ، مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ الْقَسَامَةَ كَانَتْ فِي الْجَاهِلِيَّةِ قَسَامَةَ الدَّمِ ، فَأَقَرَّهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى مَا كَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ ، وَقَضَى بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ أُنَاسٍ مِنَ الْأَنْصَارِ مِنْ بَنِي حَارِثَةَ ادَّعُوهُ عَلَى الْيَهُودِ .
It is narrated from an Ansari companion (may Allah be pleased with him) that in the time of ignorance, the practice of Qasamah was prevalent regarding murder. The Prophet (peace and blessings be upon him) maintained it in the same manner as in the time of ignorance, and in the case of some Ansar whose affiliation was with Banu Harithah and who had made a claim against the Jews, the Prophet (peace and blessings be upon him) gave the same verdict.
