Explanation of Semi-Intentional Killing: Upon Whom Is the Blood Money?

Hazrat Mughira narrates that Ibrahim said: A killing that is committed without a weapon is considered shibh-e-amd (quasi-intentional murder), and in such a case, the blood money (diyat) is obligatory upon the family members.

Hazrat Sha’bah says that I asked Hazrat Hammad about accidental killing that is done without a weapon. He replied: Its blood money will be obligatory from the wealth of the killer. And when I asked Hazrat Hakam, he said: Its blood money will be obligatory upon the family members.

29208 - Al-Hakam said: It is upon the 'aqilah (the male relatives responsible for blood money).

Ismail narrates that Hazrat Harith and Ibn Shubrumah, both of these gentlemen, stated: The blood money (diyah) for quasi-intentional killing (shibh-i-amd) will be obligatory from the wealth of the killer.

Hazrat Saeed has also narrated the aforementioned statement from Hazrat Qatadah.

Hazrat Shaibani states that Hazrat Sha'bi, Hazrat Hakam, and Hazrat Hammad—all these personalities have said: Whoever is harmed with a whip, stone, or stick and dies as a result, then this will be considered quasi-intentional murder (shibh-i-amd), and in this case, a severe blood money (diyat-e-mughallazah) will be obligatory upon the family of the perpetrator.

Hasan Basri narrates that the Messenger of Allah, peace and blessings be upon him, said: A person killed with a whip or a stick will be considered as killed by quasi-intent. In such a case, one hundred camels will be obligatory as blood money, of which forty should be pregnant.
