Is a Hired Worker Liable in Case of Loss?

Hazrat Ali (may Allah be pleased with him) and Hazrat Shurayh used to consider the employee as a guarantor.

Hazrat Ali (may Allah be pleased with him) held the carpenter liable.

Hazrat Ali (may Allah be pleased with him) said: Whoever takes wages is responsible.

It is narrated similarly through another chain.

Hazrat Abdullah bin Utbah bin Masood states that the wage of a hired worker will be guaranteed to him, and he will also be responsible for the item in his possession.

Ibrahim says that when a joint laborer takes something, he will be held liable.

Hazrat Abdur Rahman bin Yazid says that when he bought something, he will receive a reward from the one who assigned the task, and Hazrat Hakam says that he will be held liable.

It is narrated similarly through another chain of transmission.

Muhammad used to hold the hired worker liable only in case of loss.

Hazrat Ibn Sirin says that every hired worker who takes wages is liable, except for an enemy and that hired worker whose hand is with your hand.

Hazrat Sha'bi says that a hired worker on a monthly wage is not liable for guarantee.

Hazrat Shurayh did not hold the boatman liable in the event of the boat sinking or burning.

Hazrat Ali (may Allah be pleased with him) used to hold a joint employee liable.

Hazrat Abu Haitham Attar says that I hired a laborer to carry my load; he broke my belongings. I took my case to the court of Hazrat Shurayh, and he held the laborer liable and said that you hired him to deliver your goods, not to break them.

Hazrat Zuhair Ansari says that a man hired another man to work with a camel. The hired man struck the camel in such a way that he blinded its eye. The owner took the matter to the court of Hazrat Shurayh, who held the hired man liable and said, "He hired you to improve the work, not to ruin it!"
