حَدَّثَنَا أَبُو مُسْلِمٍ الْكَشِّيُّ، ثنا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ، ثنا حَمَّادُ بْنُ سَلَمَةَ، عَنْ دَاوُدَ، عَنِ الشَّعْبِيِّ، عَنْ عَلْقَمَةَ، عَنِ ابْنِ مَسْعُودٍ قَالَ: «لَهَا صَدَاقُ نِسَائِهَا، لَا وَكْسَ، وَلَا شَطَطَ، وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ» ، فَقَامَ أَبُو سِنَانٍ الْأَشْجَعِيُّ فِي رَهْطٍ مِنْ أَشْجَعَ، فَشَهِدُوا «أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى بِذَلِكَ فِي بَرْوَعَ بِنْتِ وَاشِقٍ الْأَشْجَعِيِّ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "She is entitled to the dower of women like her, with no reduction and no excess; she must observe the waiting period ('iddah), and she will inherit." Then Abu Sinan al-Ashja'i (may Allah be pleased with him) stood up with a group of people from Ashja' and testified "that the Prophet (peace and blessings be upon him) gave this very judgement in the case of Barwa' bint Washiq al-Ashja'iyyah."
حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ، عَنْ عَبْدِ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ قَالَ: أُتِيَ عَبْدُ اللهِ بْنُ مَسْعُودٍ فَسُئِلَ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا، وَلَمْ يُصِبْهَا حَتَّى مَاتَ، فَرَدَّدَهُمْ، ثُمَّ قَالَ: فَإِنِّي أَقُولُ فِيهَا بِرَأْيِي، فَإِنْ كَانَ صَوَابًا فَمِنَ اللهِ، وَإِنْ كَانَ خَطَأً فَمِنِّي، أَرَى «لَهَا صَدَاقَ امْرَأَةٍ مِنْ نِسَائِهَا - لَا وَكْسَ وَلَا شَطَطَ - وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ» ، فَقَامَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ فَقَالَ: «أَشْهَدُ لَقَضَيْتَ فِيهَا بِقَضَاءِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي بَرْوَعَ بِنْتِ وَاشِقٍ» امْرَأَةٌ مِنْ بَنِي رَوَاسٍ حَيٍّ مِنْ بَنِي عَامِرِ بْنِ صَعْصَعَةَ وَبِهِ يَأْخُذُ سُفْيَانُ
Alqamah (may Allah have mercy on him) said: A question was brought to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about a man who married a woman without fixing a dower for her, and he died before consummating the marriage with her. He sent the questioners back several times, then said: I will give my own opinion on it; if it is correct, it is from Allah, and if it is wrong, it is from me. My opinion is that "she will receive the dower of women like her, with no reduction and no excess; she must observe the waiting period ('iddah), and she will inherit." Then Ma'qil bin Sinan al-Ashja'i (may Allah be pleased with him) stood up and said: "I testify that you have judged in this exactly as the Messenger of Allah (peace and blessings be upon him) judged in the case of Barwa' bint Washiq." She was a woman of Banu Ru'as, a clan of Banu Amir bin Sa'sa'ah. And Sufyan also adopts this view.
حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ، ثنا أَبُو حُذَيْفَةَ، ثنا سُفْيَانُ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، أَنَّ ابْنَ مَسْعُودٍ، أُتِيَ فِي رَجُلٍ هَلَكَ وَتَرَكَ امْرَأَتَهُ وَلَمْ يَكُنْ دَخَلَ بِهَا، وَلَمْ يَفْرِضْ لَهَا صَدَاقًا، فَتَرَدَّدُوا إِلَيْهِ فِيهَا شَهْرًا لَا يَقُولُ فِيهَا شَيْئًا، فَقَالَ: أَقُولُ فِيهَا بِرَأْيِي، فَإِنْ يَكُنْ خَطَأً فَمِنْ نَفْسِي، وَإِنْ يَكُنْ صَوَابًا فَمِنَ اللهِ، أَقُولُ: «لَهَا مَهْرُ نِسَائِهَا، وَعَلَيْهَا الْعِدَّةُ، وَلَهَا الْمِيرَاثُ» ، فَقَامَ مَعْقِلُ بْنُ يَسَارٍ الْأَشْجَعِيُّ فَقَالَ: «قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي بَرْوَعَ بِنْتِ وَاشِقٍ مِثْلَ مَا قَضَيْتَ» ، فَفَرِحَ ابْنُ مَسْعُودٍ
It is narrated from Alqamah (may Allah have mercy on him) that a question was brought to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about a man who had died leaving his wife; he had not consummated the marriage with her, nor fixed a dower for her. People kept coming back to Ibn Mas'ud (may Allah be pleased with him) about it for a month, and he would say nothing. Then he said: I will give my own opinion on it; if it is wrong, it is from me, and if it is correct, it is from Allah. I say: "She will receive the dower of women like her; she must observe the waiting period ('iddah), and she will inherit." Then Ma'qil bin Yasar al-Ashja'i (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) gave exactly the same judgement in the case of Barwa' bint Washiq as you have given." And Ibn Mas'ud (may Allah be pleased with him) was delighted.
حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ، ثنا أَبُو حُذَيْفَةَ، ثنا سُفْيَانُ، عَنْ فِرَاسٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، قَالَ: أُتِيَ عَبْدُ اللهِ فِي رَجُلٍ تَرَكَ امْرَأَتَهُ وَلَمْ يَكُنْ دَخَلَ بِهَا، فَتَرَدَّدُوا إِلَيْهِ فِيهَا شَهْرًا لَا يَقْضِي فِيهَا بِشَيْءٍ، فَقَالَ: أَقُولُ فِيهَا بِرَأْيِي، فَإِنْ يَكُنْ خَطَأً فَمِنْ نَفْسِي، وَإِنْ يَكُنْ صَوَابًا فَمِنَ اللهِ، «مِثْلُ مَهْرِ نِسَائِهَا، وَعَلَيْهَا الْعِدَّةُ، وَلَهَا الْمِيرَاثُ» ، فَقَامَ أَبُو سِنَانٍ الْأَشْجَعِيُّ فَقَالَ: «قَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي بَرْوَعَ بِنْتِ وَاشِقٍ بِذَلِكَ» فَفَرِحَ بِذَلِكَ عَبْدُ اللهِ
Masruq (may Allah have mercy on him) said: A question was brought to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about a man who left his wife without having consummated the marriage with her. People kept coming back to him about it for a month, and he would give no judgement. Then he said: I will give my own opinion on it; if it is wrong, it is from me, and if it is correct, it is from Allah: "She will receive the like of the dower of women like her; she must observe the waiting period ('iddah), and she will inherit." Then Abu Sinan al-Ashja'i (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) gave this very judgement in the case of Barwa' bint Washiq." And Abdullah bin Mas'ud (may Allah be pleased with him) was delighted by that.
حَدَّثَنَا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ، وَأَبُو عُبَيْدَةَ عَبْدُ الْوَارِثِ بْنُ إِبْرَاهِيمَ الْعَسْكَرِيُّ قَالَا: ثنا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ، ثنا الْمُحَارِبِيُّ، ثنا يَزِيدُ بْنُ عَبْدِ الرَّحْمَنِ الدَّالَانِيُّ، عَنْ فِرَاسٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللهِ، فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا، وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا، فَقَالَ: «لَهَا الصَّدَاقُ كَامِلًا، وَعَلَيْهَا الْعِدَّةُ، وَلَهَا الْمِيرَاثُ» ، فَقَالَ مَعْقِلُ بْنُ سِنَانٍ: سَمِعْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ «قَضَى بِهِ فِي بَرْوَعَ بِنْتِ وَاشِقٍ»
Masruq (may Allah have mercy on him) narrates from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) concerning a man who married a woman and then died before consummating the marriage with her, without having fixed a dower for her, that he said: "She will receive the full dower; she must observe the waiting period ('iddah), and she will inherit." Then Ma'qil bin Sinan (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him): "He (peace and blessings be upon him) gave this very judgement in the case of Barwa' bint Washiq."
حَدَّثَنَا عُبَيْدُ بْنُ غَنَّامٍ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ثنا مُحَمَّدُ بْنُ فُضَيْلٍ، ثنا عَطَاءُ بْنُ السَّائِبِ قَالَ: شَهِدَ عِنْدِي نَفَرٌ مِنْ أَهْلِ الْبَصْرَةِ - فِيهِمُ الْحَسَنُ بْنُ أَبِي الْحَسَنِ - عَنْ مَعْقِلِ بْنِ سِنَانٍ الْأَشْجَعِيِّ قَالَ: مَرَّ عَلَيَّ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَأَنَا أَحْتَجِمُ فِي ثَمَانِيَ عَشْرَةَ خَلَتْ مِنْ رَمَضَانَ فَقَالَ: «أَفْطَرَ الْحَاجِمُ وَالْمَحْجُومُ»
Ata' bin al-Sa'ib (may Allah have mercy on him) said: A group of the people of Basrah - among them al-Hasan bin Abi al-Hasan - testified before me about Sayyiduna Ma'qil bin Sinan al-Ashja'i (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) passed by me while I was being cupped on the eighteenth of Ramadan, and he (peace and blessings be upon him) said: "The one who cups and the one who is cupped have both broken their fast."
حَدَّثَنَا إِبْرَاهِيمُ بْنُ دُحَيْمٍ الدِّمَشْقِيُّ، ثنا أَبِي، ثنا ابْنُ أَبِي فُدَيْكٍ، عَنْ مُوسَى بْنِ يَعْقُوبَ، ح وَحَدَّثَنَا مَسْعَدَةُ بْنُ سَعْدٍ الْعَطَّارُ الْمَكِّيُّ، وَمُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَضْرَمِيُّ قَالَا: ثنا إِبْرَاهِيمُ بْنُ الْمُنْذِرِ الْحِزَامِيُّ، حَدَّثَنَا مَعْنُ بْنُ عِيسَى، حَدَّثَنَا مُوسَى بْنُ يَعْقُوبَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحُوَيْرِثِ، عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ قَالَ: جَاءَنِي مَعْقِلُ بْنُ سِنَانٍ، فَأَخْبَرَنِي أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «غِفَارٌ، وَأَسْلَمُ، وَجُهَيْنَةُ، وَمُزَيْنَةُ مَوَالِيَ اللهِ عَزَّ وَجَلَّ وَرَسُوِلهِ»
Nafi' bin Jubayr bin Mut'im (may Allah have mercy on him) said: Ma'qil bin Sinan (may Allah be pleased with him) came to me and told me that the Messenger of Allah (peace and blessings be upon him) said: "Ghifar, Aslam, Juhaynah and Muzaynah are the allies (mawali) of Allah, the Mighty and Majestic, and of His Messenger."
