Qabisah bin Dhu'ayb al-Khuza'i said: A grandmother came to Sayyiduna Abu Bakr (may Allah be pleased with him) seeking her inheritance from (the estate of) her son or daughter. Sayyiduna Abu Bakr (may Allah be pleased with him) said: I do not find anything for you in the Book of Allah, nor have I heard the Messenger of Allah (peace and blessings be upon him) decide anything for you, and I will ask the people in the evening. When he had prayed the Zuhr prayer, he turned to the people and said: A grandmother has come to me asking about her inheritance from (the estate of) her son or daughter, and I have not found anything for her in the Book of Allah, nor have I heard the Messenger of Allah (peace and blessings be upon him) give any decision for her. Has any of you heard anything from the Messenger of Allah (peace and blessings be upon him) about this? Al-Mughirah bin Shu'bah (may Allah be pleased with him) stood up and said: "I saw the Messenger of Allah (peace and blessings be upon him) give her one sixth." So Sayyiduna Abu Bakr (may Allah be pleased with him) gave her one sixth. Then he asked: Did anyone else hear this along with you? Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) stood up and said: I too saw the Messenger of Allah (peace and blessings be upon him) give her one sixth. So Sayyiduna Abu Bakr (may Allah be pleased with him) gave her one sixth. When the caliphate of Sayyiduna Umar (may Allah be pleased with him) came, the grandmother from the other side (that is, the maternal grandmother) came to him, and Sayyiduna Umar (may Allah be pleased with him) said: That decision was for someone other than you, but if the two of you are together, the one sixth will be divided between you, and whichever of you is alone will receive all of it.

Qabisah bin Dhu'ayb said: A grandmother came to Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) and asked him about her inheritance in the Book of Allah. Sayyiduna Abu Bakr (may Allah be pleased with him) said to her: There is nothing for you in the Book of Allah, and I know of nothing for you in the Sunnah of the Messenger of Allah (peace and blessings be upon him), so go back until I ask the people. So he asked the people, and al-Mughirah bin Shu'bah (may Allah be pleased with him) said: "I was present with the Messenger of Allah (peace and blessings be upon him); he (peace and blessings be upon him) gave her one sixth." Sayyiduna Abu Bakr (may Allah be pleased with him) said: Is there anyone else with you? Sayyiduna Muhammad bin Maslamah al-Ansari (may Allah be pleased with him) stood up and said the same as al-Mughirah (may Allah be pleased with him) had said, so Sayyiduna Abu Bakr (may Allah be pleased with him) implemented this decision for her. Then the other grandmother came to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) asking for her inheritance, and he said: There is nothing for you in the Book of Allah, and the decision that was made was only for someone other than you, and I will not add anything to the fixed shares (fara'id); but it is that same one sixth: if the two of you share in it, it will be divided between you, and whichever of you is left alone will receive all of it.

Qabisah bin Dhu'ayb said: A grandmother came to Sayyiduna Abu Bakr (may Allah be pleased with him) and said: My son's son or my daughter's son has died, and I have been told that I have a right in what he left; so what is my right? Sayyiduna Abu Bakr (may Allah be pleased with him) said: I do not know of anything for you in the Book of Allah, and I will ask; go back. When he had prayed Zuhr, he said: Has anyone heard anything from the Messenger of Allah (peace and blessings be upon him) about grandmothers? Al-Mughirah bin Shu'bah (may Allah be pleased with him) said: I have heard it. He said: How did you hear it? He said: "He (peace and blessings be upon him) gave the grandmother one sixth." He said: Does anyone besides you also know this? Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) stood up and said: He has spoken the truth; it is just as he said. So the woman came and he gave her one sixth. When Sayyiduna Abu Bakr (may Allah be pleased with him) passed away and Sayyiduna Umar (may Allah be pleased with him) became caliph, a woman came to him in a similar matter and said what the first woman had said to Abu Bakr (may Allah be pleased with him), and he too gave her the same reply that Abu Bakr (may Allah be pleased with him) had given. Then he asked, and the people told him: Al-Mughirah (may Allah be pleased with him) said such and such, and Muhammad bin Maslamah (may Allah be pleased with him) testified along with him. So Sayyiduna Umar (may Allah be pleased with him) gave her one sixth, and added this from his own side: If the two of you are together, it is for both of you, and whichever of you is left alone will receive all of it.
