حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ، عَنْ عَبْدِ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ صَالِحٍ عَنْ الشَّعْبِيِّ، عَنْ عَبْدِ خَيْرٍ الْحَضْرَمِيِّ، عَنْ زَيْدِ بْنِ أَرْقَمَ، قَالَ: " كَانَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ بِالْيَمَنِ فَأُتِيَ بِامْرَأَةٍ وَطِئَهَا ثَلَاثَةٌ فِي طُهْرٍ وَاحِدٍ، فَسَأَلَ اثْنَيْنِ: أَتُقِرَّانِ لِهَذَا الْوَلِيدِ؟ فَلَمْ يُقِرَّا، ثُمَّ سَأَلَ اثْنَيْنِ: أَتُقِرَّانِ لِهَذَا بِالْوَلِيدِ؟ ثُمَّ سَأَلَ اثْنَيْنِ، حَتَّى فَرَغَ، فَسَأَلَ اثْنَيْنِ عَنْ وَاحِدٍ، فَلَمْ يُقِرُّوا فَأَقْرَعَ بَيْنَهُمْ فَأَلْزَمَ الْوَلَدَ الَّذِي خَرَجَتْ عَلَيْهِ الْقُرْعَةُ، وَجَعَلَ عَلَيْهِ ثُلُثَيِ الدِّيَةِ، فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ "
It is narrated from Abd Khayr al-Hadrami (may Allah have mercy on him), who narrates from Sayyiduna Zayd bin Arqam (may Allah be pleased with him); he said: Sayyiduna Ali (may Allah be pleased with him) was in Yemen when a woman was brought to him with whom three men had had relations in a single period of purity. He asked two of them: "Do you acknowledge this child for this (third) one?" They did not acknowledge it. Then he asked two: "Do you acknowledge the child for this one?" He kept asking two at a time in turn until he had asked all of them, and they did not acknowledge it. So he cast lots between them and assigned the child to the one whose lot came out, and obliged him to pay two-thirds of the blood money (diyah) to the other two. This matter was brought to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) laughed so much that his (peace and blessings be upon him) molar teeth became visible.
حَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ الْعَبَّاسِ الْأَصْبَهَانِيُّ، ثنا أَبُو مَسْعُودٍ أَحْمَدُ بْنُ الْفُرَاتِ، أَنَا عَبْدُ الرَّزَّاقِ، عَنْ سُفْيَانَ، عَنِ الْأَجْلَحِ، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ خَيْرٍ، عَنْ زَيْدِ بْنِ أَرْقَمَ، مِثْلَهُ
Abd Khayr narrates: A similar hadith is also narrated from Sayyiduna Zayd bin Arqam (may Allah be pleased with him).
حَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى، ثنا مُسَدَّدٌ، ثنا خَالِدُ بْنُ سُلَيْمَانَ الشَّيْبَانِيُّ، عَنْ عَامِرٍ، عَنْ رَجُلٍ، مِنْ حَضْرَمَوْتَ، عَنْ زَيْدِ بْنِ أَرْقَمَ، أَنَّ عَلِيًّا رَضِيَ اللهُ تَعَالَى عَنْهُ كَانَ بِالْيَمَنِ فَأَتَاهُ ثَلَاثَةٌ يَتَنَازَعُونَ فِي وَلَدٍ كُلُّهُمْ يَزْعُمُ أَنَّهُ ابْنُهُ، فَخَلَا بِاثْنَيْنِ، فَقَالَ: «أَتَطِيبَانِ نَفْسًا لِهَذَا بِالْوَلَدِ؟» قَالَا: لَا، ثُمَّ خَلَا بِاثْنَيْنِ، فَقَالَ لَهُمَا مِثْلَ ذَلِكَ، فَقَالَا: لَا، فَقَالَ: «أَرَاكُمَ شُرَكَاءَ مُتَشَاكِسُونَ، وَأَنَا مُقْرِعٌ بَيْنَكُمْ» فَأَقْرَعَ بَيْنَهُمْ فَجَعَلَ الْوَلَدَ لِلَّذِي أَصَابَتْهُ الْقُرْعَةُ، وَغَرَّمَهُ ثُلُثَيِ الدِّيَةِ لِلْبَاقِينَ
A man from Hadramawt narrates from Sayyiduna Zayd bin Arqam (may Allah be pleased with him) that Sayyiduna Ali (may Allah be pleased with him) was in Yemen when three men came to him disputing over a child, each claiming that he was his son. He took two of them aside and asked: "Are you willing at heart to leave the child to this (third) one?" They said: "No." Then he took two aside and asked them the same, and they too said: "No." So he said: "I see that you are quarrelling partners, and I will cast lots between you." So he cast lots between them and assigned the child to the one whose lot came out, and imposed on him a penalty of two-thirds of the blood money (diyah) for the other two.
