حَدَّثَنَا يُوسُفُ الْقَاضِي، ثنا عَمْرُو بْنُ مَرْزُوقٍ، ح وَحَدَّثَنَا مُحَمَّدُ بْنُ عَبْدُوسٍ، ثنا عَلِيُّ بْنُ الْجَعْدِ، قَالَا: أَنَا شُعْبَةُ، عَنْ عَبْدِ الْمَلِكِ بْنِ مَيْسَرَةَ، عَنْ مُجَاهِدٍ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: خَرَجَ عَلَيْنَا رَسُولُ اللهِ، فَنَهَانَا عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا، وَأَمْرُ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ خَيْرٌ قَالَ: «مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيَمْنَحْهَا أَوْ لِيَذَرْهَا» ، فَذُكِرَ ذَلِكَ لِطَاوُسٍ، فَقَالَ: إِنَّ ابْنَ عَبَّاسٍ رَضِيَ اللهُ عَنْهُ كَانَ أَعْلَمَ قَالَ: قَالَ ابْنُ عَبَّاسٍ: «لِأَنْ يَمْنَحَ الرَّجُلُ أَخَاهُ أَرْضَهُ خَيْرٌ لَهُ»
Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) came out to us and forbade us from something that was beneficial to us, whereas the command of the Messenger of Allah (peace and blessings be upon him) is better. He (peace and blessings be upon him) said: "Whoever has land, let him cultivate it himself, or give it to someone, or leave it." When this was mentioned to Tawus, he said: Ibn Abbas (may Allah be pleased with them both) had more knowledge about this. He said: Ibn Abbas (may Allah be pleased with them both) said: "That a man gives his land to his brother as a gift is better for him."
