حَدَّثَنَا عُبَيْدُ بْنُ غَنَّامٍ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ح وَحَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى، ثنا مُسَدَّدٌ، ح وَحَدَّثَنَا يُوسُفُ الْقَاضِي، ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ، ثنا يَحْيَى بْنُ سَعِيدٍ، ثنا أَبُو جَعْفَرٍ الْخَطْمِيُّ، قَالَ: أَتَيْتُ سَعِيدَ بْنَ الْمُسَيِّبِ، فَقُلْتُ بَلَغَنَا عَنْكَ شَيْءٌ فِي الْمُزَارَعَةِ، فَقَالَ: كَانَ ابْنُ عُمَرَ لَا يَرَى بِهِ بَأْسًا حَتَّى ذَكَرَ لَهُ رَافِعُ بْنُ خَدِيجٍ فِيهِ حَدِيثًا فَأَتَى رَافِعًا، فَأَخْبَرَهُ رَافِعٌ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَتَى بَنِي حَارِثَةَ فَرَأَى زَرْعًا فِي أَرْضِ ظُهَيْرٍ، فَقَالَ: «مَا أَحْسَنَ زَرْعِ ظُهَيْرٍ» ، فَقَالُوا: لَيْسَتْ لِظُهَيْرٍ قَالَ: «أَلَيْسَتْ أَرْضَ ظُهَيْرٍ؟» ، قَالُوا: بَلَى وَلَكِنَّهُ زَرْعُ فُلَانٍ قَالَ: «فَرُدُّوا عَلَيْهِ نَفَقَتُهُ وَخُذُوا زَرْعَكُمْ» ، قَالَ رَافِعٌ: فَرَدَدْنَا عَلَيْهِ نَفَقَتُهُ وَأَخَذْنَا زَرْعَنَا .
Abu Ja'far al-Khatmi (may Allah have mercy on him) said: I came to Sa'id bin al-Musayyab (may Allah have mercy on him) and said: Something has reached us from you about sharecropping (muzara'ah). He said: Ibn Umar (may Allah be pleased with them both) saw no harm in it until Rafi' bin Khadij (may Allah be pleased with him) narrated a hadith to him about it. So he came to Rafi', and Rafi' told him that the Messenger of Allah (peace and blessings be upon him) came to Banu Harithah and saw crops in the land of Zuhayr. He (peace and blessings be upon him) said: "How fine are the crops of Zuhayr!" The people said: They do not belong to Zuhayr. He (peace and blessings be upon him) said: "Is it not the land of Zuhayr?" They said: Indeed it is, but these are the crops of so-and-so. He (peace and blessings be upon him) said: "Then return his expenses to him and take your crops." Rafi' (may Allah be pleased with him) said: So we returned his expenses to him and took our crops.
