Muhammad bin Ishaq (may Allah have mercy on him) said: Muhammad bin Muslim al-Zuhri (may Allah have mercy on him) mentioned that Qabisah bin Dhu'ayb (may Allah have mercy on him) told him that the daughter of Sa'id bin Zayd bin Amr bin Nufayl, who was Mahramah bint Qays (Fatimah bint Qays was her maternal aunt), was married to Abdullah bin Amr bin Uthman, and he divorced her three times. Her maternal aunt sent for her and moved her to her own house, while Marwan bin al-Hakam was the governor of Madinah. Qabisah said: Marwan bin al-Hakam sent me to her to ask her: What led her to take a woman out of her house before her waiting period was over? She said: "Because the Messenger of Allah (peace and blessings be upon him) ordered me to do so." Then she related her story and said: "And I argue with you by the Book of Allah. Allah says in His Book: 'When you divorce women, divorce them at the start of their waiting period, and keep count of the waiting period, and fear Allah, your Lord. Do not turn them out of their houses, nor should they leave, unless they commit a clear indecency' [Al-Talaq: 1], 'You do not know; perhaps Allah will bring about some new matter after that' [Al-Talaq: 1]. This confinement was not for anything other than taking back. Then He said: 'Then when they reach their term' (that is, the third) 'either retain them in a fair manner or release them in a fair manner' [Al-Baqarah: 231]. By Allah, Allah did not mention any confinement after the third divorce, after what the Messenger of Allah (peace and blessings be upon him) ordered me." Qabisah said: Then I went back to Marwan and told him, and he said: "The hadith of a woman, the hadith of a woman." Then he gave orders concerning the woman, and she was sent back to her house until her waiting period was over.
