حَدَّثَنَا أَحْمَدُ بْنُ عَمْرٍو الْخَلَّالُ الْمَكِّيُّ، ثَنَا يَعْقُوبُ بْنُ حُمَيْدٍ، ثَنَا عَبْدُ اللهِ بْنُ يَزِيدَ الْمُقْرئُ، عَنْ سَعِيدِ بْنِ أَبِي أَيُّوبَ، أَنَّ يَزِيدَ بْنَ أَبِي حَبِيبٍ، حَدَّثَهُ أَنَّ السَّلَمَ بْنَ يَزِيدَ , وَيَزِيدَ بْنَ إِسْحَاقَ حَدَّثَاهُ، عَنْ عُمَيْرِ بْنِ أُمَيَّةَ، أَنَّهُ كَانَتْ لَهُ أُخْتٌ وَكَانَ إِذَا خَرَجَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ آذَتْهُ فِيهِ وشَتَمَتِ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَكَانَتْ مُشْرِكَةً، فَاشْتَمَلَ لَهَا يَوْمًا عَلَى السَّيْفِ، ثُمَّ أَتَاهَا فَوَضَعَهُ عَلَيْهَا فَقَتَلَهَا، فَقَامَ بَنُوهَا فَصَاحُوا وَقَالُوا: قَدْ عَلِمْنَا مَنْ قَتَلَهَا أَفَتُقْتَلُ أُمُّنَا؟ وهَؤُلَاءِ قَوْمٌ لَهُمْ آبَاءٌ وَأُمَّهَاتٌ مُشْرِكُونَ، فَلَمَّا خَافَ عُمَيْرٌ أَنْ يَقْتُلُوا غَيْرَ قَاتِلِهَا ذَهَبَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ فَقَالَ: «أَقَتَلْتَ أُخْتَكَ؟» قَالَ: نَعَمْ، قَالَ: «وَلِمَ؟» قَالَ: إِنَّهَا كَانَتْ تُؤْذِينِي فِيكَ، فَأَرْسَلَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِلَى بَنِيهَا فَسَأَلَهُمْ؟ فَسَمُّوا غَيْرَ قَاتِلِهَا، فَأَخْبَرَهُمُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِهِ وأَهْدَرَ دَمَهَا قَالُوا: سَمْعًا وَطَاعَةً
It is narrated from Sayyiduna Umayr bin Umayyah (may Allah be pleased with him) that he had a sister who was a polytheist, and whenever he set out to go to the Prophet (peace and blessings be upon him), she would trouble him over it and revile the Prophet (peace and blessings be upon him). One day he concealed a sword in his clothes, then went to her, put the sword upon her and killed her. Her sons stood up, cried out and said: "We know who killed her. Shall our mother be killed (like this)?" And these were people some of whom had polytheist fathers and mothers. When Umayr feared that they might kill someone other than her actual killer, he went to the Prophet (peace and blessings be upon him) and informed him. He (peace and blessings be upon him) asked: "Did you kill your sister?" He said: "Yes." He (peace and blessings be upon him) asked: "Why?" He said: "She used to trouble me regarding you." The Prophet (peace and blessings be upon him) sent for her sons and asked them, and they named someone other than her actual killer. The Prophet (peace and blessings be upon him) told them the truth of the matter and declared her blood to be of no liability. They said: "We hear and we obey."
