Najdah wrote to Ibn Abbas (may Allah be pleased with them both) asking: For whom is the khums (one-fifth)? Do a slave and a woman who are present at the taking of spoils get anything from them? When is the name of orphan lifted from an orphan? And he asked about killing children. Ibn Abbas (may Allah be pleased with them both) said: Were it not that I hope Allah will benefit him through my letter, I would not write to him. Then he said: Write, O Yazid: As for the khums, we used to hold that it was ours, but our people refused us that. As for the slave and the woman who are present at the taking of spoils, they have no share of it, but they are given something voluntarily. As for the orphan, his orphanhood is lifted from him when he reaches puberty, and he becomes one of the poor of the Muslims. As for the children, do not kill them until you know about them what al-Khidr (peace be upon him) knew about the boy before he killed him. And this wording is that of the narration of Abu Ishaq al-Fazari.
