بَابُ الْيَمِينِ مَعَ الشاهد

وَقَالَ إِسْحَاقُ : أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ ، عَنْ أَبِيهِ رَضِيَ اللهُ عَنْهُ ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ . قَالَ أَبِي : " وَأَشْهَدُ أَنَّ عَلِيًّا رَضِيَ اللهُ عَنْهُ ، قَضَى بِهِ بَيْنَ أَظْهُرِكُمْ " . قَالَ عَبْدُ الْعَزِيزِ : " يَقُولُهُ مُحَمَّدُ بْنُ عَلِيٍّ لِلْحَكَمِ بْنِ عُتَيْبَةَ " .
2191 \ 2 - وَقَالَ مُسَدَّدٌ : حَدَّثَنَا يَحْيَى ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ قَالَ : سَمِعْتُ أَبِي يَقُولُ لِلْحَكَمِ بْنِ عُتَيْبَةَ فَذَكَرَهُ .
وَأَخْرَجَهُ التِّرْمِذِيُّ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ ، عَنْ جَابِرٍ ، وَأَشَارَ إِلَى حَدِيثِ عَلِيٍّ رَضِيَ اللهُ عَنْهُ .
2191 \ 2 - وَقَالَ مُسَدَّدٌ : حَدَّثَنَا يَحْيَى ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ قَالَ : سَمِعْتُ أَبِي يَقُولُ لِلْحَكَمِ بْنِ عُتَيْبَةَ فَذَكَرَهُ .
وَأَخْرَجَهُ التِّرْمِذِيُّ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ ، عَنْ جَابِرٍ ، وَأَشَارَ إِلَى حَدِيثِ عَلِيٍّ رَضِيَ اللهُ عَنْهُ .
Ja'far bin Muhammad (Imam Ja'far al-Sadiq) narrates from his father (Imam Muhammad al-Baqir) (may Allah have mercy on them both) that the Prophet (peace and blessings be upon him) gave judgement in favour of the claimant on the basis of one witness together with (the claimant's) oath.
(Ja'far's father) Muhammad bin Ali (may Allah have mercy on him) said: "And I bear witness that Sayyiduna Ali (may Allah be pleased with him) gave this same judgement among you." Abd al-Aziz (the narrator) states: Muhammad bin Ali (Imam al-Baqir) was saying this to al-Hakam bin Utaybah (al-Hakam bin Utaybah of Kufah).
The second chain (the chain of Musaddad):
It is narrated from Ja'far bin Muhammad that he said: I heard my father saying this same thing to al-Hakam bin Utaybah (and he mentioned the same content).
(The author Ibn Hajar (may Allah have mercy on him) says: Imam al-Tirmidhi (may Allah have mercy on him) narrated it through Muhammad bin Ali from Jabir, and pointed to the hadith of Sayyiduna Ali (may Allah be pleased with him).)
(Ja'far's father) Muhammad bin Ali (may Allah have mercy on him) said: "And I bear witness that Sayyiduna Ali (may Allah be pleased with him) gave this same judgement among you." وَقَالَ مُسَدَّدٌ : حَدَّثَنَا يَحْيَى ، عَنِ ابْنِ عَجْلَانَ ، حَدَّثَنِي أَبُو الزِّنَادِ قَالَ : كُنْتُ مَعَ عَبْدِ الْحَمِيدِ بِالْكُوفَةِ فَكَانَ يَقْضِي بِالْيَمِينِ مَعَ الشَّاهِدِ ، فَأَنْكَرَ عَلَيْهِ ذَلِكَ نَاسٌ مِنْ أَهْلِ الْكُوفَةِ ، فَكَتَبَ بِهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ رَضِيَ اللهُ عَنْهُ ، فَكَتَبَ أَنْ أَقْضِيَ بِالْيَمِينِ مَعَ الشَّاهِدِ فَقَامَ شَيْخٌ مِنْ كُبَرَائِهِمْ فَقَالَ : شَهِدْتُ شُرَيْحًا يَقْضِي بِالْيَمِينِ مَعَ الشَّاهِدِ فِي هَذَا الْمَسْجِدِ .
It is narrated from Musaddad (may Allah have mercy on him) through the chain of Yahya, Ibn Ajlan and Abu al-Zinad (may Allah have mercy on him) that Abu al-Zinad said: "I was with Abd al-Hamid in Kufah, and he used to judge by having (the claimant) take an oath along with one witness. Some people of Kufah objected to this, so Abd al-Hamid wrote about this issue to the Commander of the Believers Umar bin Abd al-Aziz (may Allah have mercy on him). The Commander of the Believers wrote to him: 'That I should judge by having an oath taken along with one witness.' Then one of the shaykhs from among their elders stood up and said: 'I saw Shurayh judging by an oath along with one witness in this very mosque.'"
