قَالَ إِسْحَاقُ : أَخْبَرَنَا مُحَمَّدُ بْنُ الْفَضْلِ ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ ، عَنِ الْحَسَنِ قَالَ : جَاءَ رَجُلٌ فَنَزَلَ عَلَى عَلِيٍّ رَضِيَ اللهُ عَنْهُ ، فَأَضَافَهُ فَقَالَ : إِنِّي أُرِيدُ أَنْ أُخَاصِمَ . فَقَالَ لَهُ عَلِيٌّ رَضِيَ اللهُ عَنْهُ : تَحَوَّلْ فَإِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَانَا أَنْ نَضِيفَ الْخَصْمَ إِلَّا وَمَعَهُ خَصْمُهُ .
It is narrated from Imam al-Hasan al-Basri (may Allah have mercy on him) that a man came and stayed as a guest with Sayyiduna Ali (may Allah be pleased with him), and he hosted him. Then the man said: "I want to bring a case (a claim)." Sayyiduna Ali (may Allah be pleased with him) said to him: "Move (from here) to some other place, for the Prophet (peace and blessings be upon him) forbade us 'to host a party to a dispute unless his opposing party (the defendant) is with him.'"

وَقَالَ الْحَارِثُ : حَدَّثَنَا مُحَمَّدُ بْنُ عُمَرَ ، ثَنَا مُحَمَّدُ بْنُ نُعَيْمٍ ، عَنْ أَبِيهِ ، قَالَ : شَهِدْتُ أَبَا هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ يَقْضِي ، فَجَاءَ الْحَارِثُ بْنُ الْحَكَمِ ، فَجَلَسَ عَلَى وِسَادَتِهِ الَّتِي يَتَّكِئُ عَلَيْهَا . قَالَ : فَظَنَّ أَبُو هُرَيْرَةَ أَنَّهُ جَاءَ لِحَاجَةٍ غَيْرِ الْحُكْمِ ، قَالَ : فَجَاءَ رَجُلٌ فَجَلَسَ بَيْنَ يَدَيْ أَبِي هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ ، فَقَالَ لَهُ : مَا لَكَ ؟ قَالَ : اسْتَأْدَى عَلِيَّ الْحَارِثُ ، فَقَالَ لَهُ أَبُو هُرَيْرَةَ : قُمْ فَاجْلِسْ مَعَ خَصْمِكَ ; فَإِنَّهَا سُنَّةُ أَبِي الْقَاسِمِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ .
Nu'aym (may Allah have mercy on him) states: I was present at the court session of Sayyiduna Abu Hurayrah (may Allah be pleased with him). Meanwhile al-Harith bin al-Hakam came and sat on the cushion of Sayyiduna Abu Hurayrah (may Allah be pleased with him) on which he was reclining. Sayyiduna Abu Hurayrah (may Allah be pleased with him) assumed that he had come for some need other than a judgement. Then another man came and sat in front of Sayyiduna Abu Hurayrah (may Allah be pleased with him). He (may Allah be pleased with him) asked him: "What is your matter?" He said: "Al-Harith has demanded his right against me." So Sayyiduna Abu Hurayrah (may Allah be pleased with him) said (to al-Harith): "Get up and sit beside your opponent, for this is the Sunnah (blessed way) of Sayyiduna Abu al-Qasim (peace and blessings be upon him)."

وَقَالَ أَبُو بَكْرٍ : حَدَّثَنَا شَبَابَةُ ، ثَنَا لَيْثُ بْنُ سَعْدٍ ، عَنْ عَمْرِو [بْنِ أَبِي عَمْرٍو ] ، عَنِ الْمُطَّلِبِ قَالَ : إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : مَنْ شَدَّ عَلَى - غَفْلَةٍ - مُخَاصِمٍ بِغَيْرِ عِلْمٍ بِخُصُومَتِهِ لَمْ يَزَلْ فِي سَخَطِ اللهِ تَعَالَى حَتَّى يَنْزِعَ .
It is narrated from al-Muttalib (may Allah have mercy on him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever backs a quarrelling party (unjustly) while being ignorant of the reality of the matter remains continually under the wrath of Allah (Allah Almighty's severe displeasure) until he withdraws from that (support)."
