بَابُ الاستبراء وَالتَّرْغِيبِ فِي الإماء

قَالَ إِسْحَاقُ : أَخْبَرَنَا عَبْدُ الرَّزَّاقِ ، أَنَا مَعْمَرٌ ، عَنْ أَيُّوبَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ رَضِيَ اللهُ عَنْهُمَا ، قَالَ : " إِذَا اشْتَرَاهَا عَذْرَاءَ ، فَإِنْ شَاءَ لَمْ يَسْتَبْرِئْهَا " .
قَالَ أَيُّوبُ : يَعْنِي ذَلِكَ فِي السَّبِيَّةِ .

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he said: "When a man buys a slave-girl while she is a virgin, then if he wishes, he need not observe istibra' for her (before intercourse) (that is, waiting for one menstrual cycle to establish that her womb is clear)."
Ayyub (may Allah have mercy on him) says: What is meant by this ruling is a slave-girl taken captive in war.

وَقَالَ أَبُو بَكْرٍ : حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ بْنِ جَابِرٍ ، ثَنَا الْقَاسِمُ ، وَمَكْحُولٌ ، عَنْ أَبِي أُمَامَةَ رَضِيَ اللهُ عَنْهُ قَالَ : " إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى يَوْمَ خَيْبَرَ أَنْ تُوطَأَ الْحَبَالَى حَتَّى يَضَعْنَ " .
1727 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو مَعْمَرٍ الْهُذَلِيُّ إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ ، نَبَا أَبُو أُسَامَةَ ... فَذَكَرَهُ مُطَوَّلًا.
1727 \ 2 - وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا أَبُو مَعْمَرٍ الْهُذَلِيُّ إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ ، نَبَا أَبُو أُسَامَةَ ... فَذَكَرَهُ مُطَوَّلًا.
It is narrated from Sayyiduna Abu Umamah (may Allah be pleased with him): "The Messenger of Allah (peace and blessings be upon him), on the occasion of the expedition of Khaybar, forbade having intercourse with pregnant women (slave-women) until they had delivered (that is, until the child was born)."

وَقَالَ ابْنُ أَبِي عُمَرَ : حَدَّثَنَا بِشْرٌ - هُوَ ابْنُ السَّرِيِّ - ، ثَنَا الزُّبَيْرُ بْنُ سَعِيدٍ الْهَاشِمِيُّ ، حَدَّثَنِي ابْنُ عَمٍّ لِي مِنْ بَنِي هَاشِمٍ قَالَ : إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ : " عَلَيْكُمْ بِالسَّرَارِيِّ ، فَإِنَّهُنَّ مُبَارَكَاتُ الْأَرْحَامِ " .
هَذَا مُرْسَلٌ لَا بَأْسَ بِإِسْنَادِهِ .
وَقَدْ رُوِيَ مَوْصُولًا مِنْ حَدِيثِ أَبِي الدَّرْدَاءِ رَضِيَ اللهُ عَنْهُ ، أَخْرَجَهُ الْحَاكِمُ ، وَإِسْنَادُهُ وَاهٍ جِدًّا ، حَتَّى أَخْرَجَهُ ابْنُ الْجَوْزِيِّ فِي مَوْضُوعَاتِهِ .
هَذَا مُرْسَلٌ لَا بَأْسَ بِإِسْنَادِهِ .
وَقَدْ رُوِيَ مَوْصُولًا مِنْ حَدِيثِ أَبِي الدَّرْدَاءِ رَضِيَ اللهُ عَنْهُ ، أَخْرَجَهُ الْحَاكِمُ ، وَإِسْنَادُهُ وَاهٍ جِدًّا ، حَتَّى أَخْرَجَهُ ابْنُ الْجَوْزِيِّ فِي مَوْضُوعَاتِهِ .
It is narrated from a man of Banu Hashim (who was a cousin of the narrator) that the Messenger of Allah (peace and blessings be upon him) said: "Hold fast to slave-women, for their wombs are blessed."
This narration is mursal, yet there is no harm in its chain.
This hadith is also narrated with a connected chain from Sayyiduna Abu al-Darda' (may Allah be pleased with him), which Imam al-Hakim recorded; but its chain is so feeble and extremely weak that Imam Ibn al-Jawzi included it in his 'Kitab al-Mawdu'at' (collection of fabricated narrations).

وَقَالَ أَبُو يَعْلَى : حَدَّثَنَا زَحْمَوَيْهِ ، ثَنَا ابْنُ أَبِي الزِّنَادِ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَخْبَرَنِي الثِّقَةُ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى يَوْمَ خَيْبَرَ أَنْ تُوطَأَ الْحَبَالَى ، وَقَالَ : " تَسْقِي زَرْعَ غَيْرِكَ . ؟ !! "
Imam Abu Ya'la (may Allah have mercy on him) narrates: Zahmawayh narrated to us from Ibn Abi al-Zinad, he from Yahya bin Sa'id, and a thiqah (trustworthy) person informed him that the Messenger of Allah (peace and blessings be upon him), on the occasion of the expedition of Khaybar, forbade intercourse with pregnant women, and said (by way of rebuke): "Do you want to water (with your seed) someone else's crop?"
وَقَالَ الطَّيَالِسِيُّ : حَدَّثَنَا رَبَاحُ بْنُ أَبِي مَعْرُوفٍ ، عَنْ عَطَاءٍ ، عَنْ جَابِرٍ رَضِيَ اللهُ عَنْهُ قَالَ : " إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ نَهَى أَنْ تُوطَأَ النِّسَاءُ الْحَبَالَى مِنَ السَّبْيِ ".
It is narrated from Sayyiduna Jabir (may Allah be pleased with him): "Indeed the Messenger of Allah (peace and blessings be upon him) forbade having intercourse with pregnant women from among the war captives (before they deliver)."
وَقَالَ الْحَارِثُ : حَدَّثَنَا الْعَبَّاسُ بْنُ الْفَضْلِ ، ثَنَا حُمَيْدُ بْنُ الْأَسْوَدِ ، وَيَزِيدُ بْنُ إِبْرَاهِيمَ ، عَنْ حُمَيْدٍ ، عَنْ أَنَسٍ رَضِيَ اللهُ عَنْهُ قَالَ : إِنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ اسْتَبْرَأَ صَفِيَّةَ رَضِيَ اللهُ عَنْهَا فَقِيلَ لَهُ : مِنْ أُمَّهَاتِ الْمُؤْمِنِينَ ، أَوْ مِنْ أُمَّهَاتِ الْأَوْلَادِ ؟ قَالَ : "مِنْ أُمَّهَاتِ الْمُؤْمِنِينَ ".
It is narrated from Sayyiduna Anas (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) observed istibra' (waiting to confirm she was not pregnant) for Sayyidah Safiyyah (may Allah be pleased with her) (that is, before marriage he made sure that her womb was clear and free). He (peace and blessings be upon him) was then asked whether she would be counted among the Mothers of the Believers or among the umm al-walad (slave mothers). He (peace and blessings be upon him) said: "She is among the Mothers of the Believers."
