بَابُ الْخَرْصِ فِي الثِّمَارِ

قَالَ مُسَدَّدٌ : حَدَّثَنَا حَمَّادٌ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ بُشَيْرِ بْنِ يَسَارٍ ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ ، قَالَ : إِنَّ عُمَرَ - رَضِيَ اللهُ عَنْهُ - بَعَثَهُ عَلَى خَرْصِ التَّمْرِ ، فَقَالَ : إِذَا أَتَيْتَ عَلَى أَرْضٍ فَاخْرُصْهَا ، وَدَعْ لَهُمْ قَدْرَ مَا يَأْكُلُونَ .
إِسْنَادُهُ صَحِيحٌ ، وَهُوَ مَوْقُوفٌ ، وَقَدْ أَخْرَجُوا بِهَذَا الْإِسْنَادِ ، عَنْ سَهْلٍ - رَضِيَ اللهُ عَنْهُ - عَنِ النَّبِيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - مَرْفُوعًا .
إِسْنَادُهُ صَحِيحٌ ، وَهُوَ مَوْقُوفٌ ، وَقَدْ أَخْرَجُوا بِهَذَا الْإِسْنَادِ ، عَنْ سَهْلٍ - رَضِيَ اللهُ عَنْهُ - عَنِ النَّبِيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - مَرْفُوعًا .
It is narrated from Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) that the Commander of the Believers Sayyiduna Umar al-Faruq (may Allah be pleased with him) sent him to estimate the date harvest and instructed him: "When you come to a piece of land, estimate its produce, and (when calculating the zakah) leave for the owners as much as they themselves eat."
The chain of this report is sahih (authentic) and it is mawquf; however, the hadith scholars have also narrated it with this same chain, through Sayyiduna Sahl (may Allah be pleased with him), from the Prophet (peace and blessings be upon him) as marfu' (attributed to the Prophet).

وَقَالَ الْحَارِثُ : حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ أَبَانَ ، حَدَّثَنَا إِسْرَائِيلُ ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ الْأَعْلَى ، عَنْ إِسْحَاقَ بْنِ الْحَكَمِ ، عَنْ مُحَمَّدِ بْنِ رَافِعِ بْنِ خَدِيجٍ ، عَنْ رَافِعِ بْنِ خَدِيجٍ - رَضِيَ اللهُ عَنْهُ - ، أَنَّ رَسُولَ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - بَعَثَ رَجُلًا إِلَى قَوْمٍ فَطَمَسَ عَلَيْهِمْ نَخْلَهُمْ ، فَأَتَوْا رَسُولَ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - فَقَالُوا : أَتَانَا فُلَانٌ فَطَمَسَ عَلَيْنَا نَخْلَنَا ، فَقَالَ رَسُولُ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - : لَقَدْ بَعَثْتُهُ وَإِنَّهُ لَفِي نَفْسِي لَأَمِينٌ ، فَإِنْ شِئْتُمْ أَخَذْتُمْ مَا طَمَسَ عَلَيْكُمْ ، وَإِنْ شِئْتُمْ أَخَذْنَاهُ ، وَرَدَدْنَاهُ عَلَيْكُمْ . قَالُوا : هَذَا الْحَقُّ ، وَبِالْحَقِّ قَامَتِ السَّمَاوَاتُ وَالْأَرْضُ .
It is narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) sent a man to a certain people (to collect zakah and sadaqah), and he wronged them in the matter of their date-palm orchards. So those people came to the Messenger of Allah (peace and blessings be upon him) and said: "So-and-so came to us and wronged us in estimating our date harvest." At this the Messenger of Allah (peace and blessings be upon him) said: "When I sent him, he was certainly a trustworthy man in my view. Now, if you wish, take (yourselves) recompense for the wrong he did you, and if you wish, we ourselves will take that wealth from him and return it to you." They said: "This is the very truth, and it is by the truth that the heavens and the earth stand."
