بَابُ الْغَدِيرِ يَقَعُ فِيهِ الْجِيفَةُ وَحُكْمِ الْمَاءِ الرَّاكِدِ

قَالَ مُسَدَّدٌ : حَدَّثَنَا إِسْمَاعِيلُ ، ثَنَا عَوْفٌ ، حَدَّثَنِي شَيْخٌ كَانَ يَقْضِي عَلَيْنَا فِي مَسْجِدِ الْأَشْيَاخِ قَبْلَ وَقْعَةِ ابْنِ الْأَشْعَثِ قَالَ : بَلَغَنِي أَنَّ أَصْحَابَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَانُوا فِي مَسِيرٍ ، فَانْتَهَوْا إِلَى غَدِيرٍ فِي نَاحِيَةٍ مِنْهُ جِيفَةٌ ، فَأَمْسَكُوا عَنْهُ حَتَّى جَاءَهُمْ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، فَقَالُوا : يَا رَسُولَ اللهِ ، هَذَا الْغَدِيرُ فِي نَاحِيَةٍ مِنْهُ جِيفَةٌ ؟ فَقَالَ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : " اسْقُوا وَاسْتَقُوا ; فَإِنَّ الْمَاءَ يَحِلُّ وَلَا يَحْرُمُ " .

It is narrated from an elderly man (shaykh) who used to be a judge in the Mosque of al-Ashyakh before the affair of Ibn al-Ash'ath, that he said: It reached me that the Companions of the Messenger of Allah (peace and blessings be upon him), during a journey, reached a pool at one edge of which lay a carcass, so they held back from using it until the Messenger of Allah (peace and blessings be upon him) came to them. They said: "O Messenger of Allah, at one corner of this pool there lies a carcass?" He (peace and blessings be upon him) said: "Drink yourselves and give others (that is, your animals) to drink, for water remains lawful and does not become unlawful (merely because of this)."

وَقَالَ ابْنُ أَبِي شَيْبَةَ : حَدَّثَنَا عَلِيُّ بْنُ هَاشِمٍ
8 \ 2 - وَقَالَ أَحْمَدُ بْنُ مَنِيعٍ : حَدَّثَنَا هُشَيْمٌ كِلَاهُمَا عَنِ ابْنِ أَبِي لَيْلَى ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ رَضِيَ اللهُ عَنْهُ قَالَ : " كُنَّا نَسْتَحِبُّ أَنْ نَأْخُذَ مِنْ مَاءِ الْغَدِيرِ نَغْتَسِلُ بِهِ فِي نَاحِيَةٍ ; لِلنَّهْيِ عَنِ الْبَوْلِ فِي الْمَاءِ الرَّاكِدِ " .
8 \ 2 - وَقَالَ أَحْمَدُ بْنُ مَنِيعٍ : حَدَّثَنَا هُشَيْمٌ كِلَاهُمَا عَنِ ابْنِ أَبِي لَيْلَى ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ رَضِيَ اللهُ عَنْهُ قَالَ : " كُنَّا نَسْتَحِبُّ أَنْ نَأْخُذَ مِنْ مَاءِ الْغَدِيرِ نَغْتَسِلُ بِهِ فِي نَاحِيَةٍ ; لِلنَّهْيِ عَنِ الْبَوْلِ فِي الْمَاءِ الرَّاكِدِ " .
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that he said: "We used to consider it recommended and preferable to take some water from the collected water of a pool or pond and bathe with it, moving aside to one side; and this practice was due to the prohibition that has come regarding urinating in stagnant water."
وَقَالَ إِسْحَاقُ : أَنَا سُفْيَانُ ، عَنْ مَنْبُوذٍ ، عَنْ أُمِّهِ قَالَتْ : " كُنَّا نُسَافِرُ مَعَ مَيْمُونَةَ فَتَنْزِلُ عَلَى الْغُدْرَانِ فِيهَا الْجِعْلَانُ وَالْبَعْرُ ، فَنَسْتَقِي لَهَا مِنْهُ ، لَا تَرَى بِذَلِكَ بَأْسًا " .
Manbudh narrates from his mother that she said: "We used to travel with the Mother of the Believers, Sayyidah Maymunah (may Allah be pleased with her), and (during the journey) she would camp by pools and ponds in which there were dung beetles and animal droppings; then we would draw water for her from them, and she saw no harm or objection in (using) it."
