أَخْبَرَنَا النَّضْرُ بْنُ شُمَيْلٍ ، ثَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، عَنْ خَالِدِ بْنِ عَرْعَرَةَ قَالَ : لَمَّا قُتِلَ عُثْمَانُ رَضِيَ اللهُ عَنْهُ ، فَذَكَرَ حَدِيثًا فِيهِ : ثُمَّ قَامَ آخَرُ فَسَأَلَهُ يَعْنِي عَلِيًّا رَضِيَ اللهُ عَنْهُ وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يَصَّالَحَا بَيْنَهُمَا صُلْحًا . قَالَ رَضِيَ اللهُ عَنْهُ : " عَنْ مِثْلِ هَذَا فَاسْأَلُوا ، هُوَ الرَّجُلُ يَكُونُ لَهُ الْمَرْأَتَانِ فَتَعْجِزُ إِحْدَاهُمَا ، أَوْ تَكُونُ ذَمِيمَةً ; فَيُصَالِحُهَا عَلَى أَنْ يَأْتِيَهَا كُلَّ لَيْلَتَيْنِ أَوْ ثَلَاثًا مَرَّةً " .
It is narrated from Khalid bin Ar'arah that when Sayyiduna Uthman (may Allah be pleased with him) was martyred (the narrator related a long hadith in which it is mentioned that) another man then stood up and asked Sayyiduna Ali (may Allah be pleased with him) about the words of Allah Almighty: "And if a woman fears ill-conduct or desertion from her husband, there is no sin upon them if they make a settlement between themselves" [Surah al-Nisa: 128]. He (may Allah be pleased with him) said: "Ask (me) about such matters of knowledge. What is meant is a man who has two wives, and one of them becomes incapable (of fulfilling marital rights due to old age or some other excuse), or she is unattractive (in appearance), so the woman makes a settlement with her husband that he will come to her once every two or three nights (in the allotment of turns)."
Imam al-Bayhaqi recorded this report in al-Sunan al-Kubra, and the narrators in its chain are thiqat (trustworthy).
