It is narrated from Imam al-Zuhri (may Allah have mercy on him): "The Messenger of Allah (peace and blessings be upon him) did not fix any definitive prescribed punishment (hadd) for drinking wine, until Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) set for it a punishment of forty lashes."
It is narrated from Imam Ibn Shihab al-Zuhri (may Allah have mercy on him) that Sayyiduna al-Sa'ib bin Yazid (may Allah be pleased with him) said: "Then Sayyiduna Umar al-Faruq (may Allah be pleased with him) (in view of the worsening situation) fixed eighty lashes, while in the time of Sayyiduna Uthman al-Ghani (may Allah be pleased with him) sometimes eighty and sometimes forty lashes were given. The situation was that when a person was brought to him who was addicted to drinking and stayed drunk through heavy drinking, he would give him eighty lashes, and when a person was brought who had merely committed an incidental slip or lapse, he would give him forty lashes."
