Al-Matalib al-'Aliyah 1595 — Women have no independent say in marriage

Al-Qasim bin Muhammad (may Allah have mercy on him) relates that the Mother of the Believers Sayyidah Aishah (may Allah be pleased with her) married the daughter of (her brother) Abd al-Rahman to al-Mundhir bin al-Zubayr. Abd al-Rahman said (expressing displeasure): Do you marry off a man's daughter without his permission and consultation? At this Sayyidah Aishah (may Allah be pleased with her) became angry and said to al-Mundhir: "Will you give her authority over her own affair (so that she can decide for herself)?" So al-Mundhir did that, and they did not regard it (the handing over of authority) as anything.
The point of jurisprudence derived from this incident is that if, for some reason, a marriage is contracted in the absence of the nearest guardian, and afterwards the husband gives the woman the choice but she remains in the marriage, that marriage remains valid and binding in the Shari'ah.
