Al-Matalib al-'Aliyah 1034 — What one who has intercourse or breaks

It is narrated from Ata and Amr bin Shu'ayb (may Allah have mercy on them both) that a man came into the presence of the Prophet (peace and blessings be upon him) and submitted: O Messenger of Allah, I am ruined! He (peace and blessings be upon him) asked: "What has ruined you?" He said: I had intercourse with my wife during (the fast of) Ramadan. Meanwhile, a donkey laden with dates was brought to the Messenger of Allah (peace and blessings be upon him); he (peace and blessings be upon him) ordered that some of it be given to the man and said: "Take this and give it in charity (as expiation)." The man said: O Messenger of Allah, between these two stony tracts (of Madinah) there is no household more destitute than mine. On hearing this, the Messenger of Allah (peace and blessings be upon him) laughed until his (peace and blessings be upon him) back teeth became visible, then he (peace and blessings be upon him) said: "Then feed it to your own family, fast one day in its place, and seek forgiveness from Allah Almighty." The narrator said: I do not remember whether this was in the account of both of them (Ata and Amr) or whether one of them said: "Fast one day in its place, and repent and seek forgiveness from Allah Almighty."
Explanation: From this blessed hadith the scholarly point is derived that the pure Shari'ah contains exceptional ease in the rules of expiation for a poor and destitute person, and that when a Ramadan fast is deliberately broken, making up that day is also required along with the expiation.
