بَابُ لَا قَوَدَ إِلَّا بِالسَّيْفِ .

عَنْ عَبْدِ اللَّهِ - يَعْنِي ابْنَ مَسْعُودٍ - قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا قَوَدَ إِلَّا بِالسَّيْفِ " . رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ أَبُو مُعَاذٍ سُلَيْمَانُ بْنُ أَرْقَمَ ، وَهُوَ مَتْرُوكٌ .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "Retaliation (qisas) shall be taken only with the sword."
Al-Tabarani recorded it. Its chain contains Abu Mu'adh Sulayman bin Arqam, who is matruk (abandoned).

وَعَنْ النُّعْمَانِ بْنِ بَشِيرٍ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " الْقَوَدُ بِالسَّيْفِ ، وَلِكُلِّ شَيْءٍ خَطَأٌ " .
قُلْتُ : رَوَى لَهُ ابْنُ مَاجَهْ : " لَا قَوَدَ إِلَّا بِالسَّيْفِ " فَقَطْ . رَوَاهُ الْبَزَّارُ ، وَفِيهِ جَابِرٌ الْجُعْفِيُّ وَهُوَ ضَعِيفٌ .
قُلْتُ : رَوَى لَهُ ابْنُ مَاجَهْ : " لَا قَوَدَ إِلَّا بِالسَّيْفِ " فَقَطْ . رَوَاهُ الْبَزَّارُ ، وَفِيهِ جَابِرٌ الْجُعْفِيُّ وَهُوَ ضَعِيفٌ .
Sayyiduna al-Nu'man bin Bashir (may Allah be pleased with him) reports this statement of the Prophet (peace and blessings be upon him): "Retaliation (qisas) shall be taken only for killing with the sword; everything else will be counted as accidental."
(Allamah Haythami says:) I say: Ibn Majah recorded from him only
this narration: "Retaliation shall be taken only with the sword."
Al-Bazzar recorded it. Its chain contains Jabir al-Ju'fi, who is da'if (weak).
