عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ :
" رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ : عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَالْمَعْتُوهِ حَتَّى يُفِيقَ ، وَالصَّبِيِّ حَتَّى يَعْقِلَ أَوْ يَحْتَلِمَ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ وَالْأَوْسَطِ ، وَقَالَ : لَا يُرْوَى عَنِ ابْنِ عَبَّاسٍ إِلَّا بِهَذَا الْإِسْنَادِ ، وَفِيهِ عَبْدُ الْعَزِيزِ بْنُ عُبَيْدِ اللَّهِ بْنِ حَمْزَةَ ، وَهُوَ ضَعِيفٌ .
" رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ : عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَالْمَعْتُوهِ حَتَّى يُفِيقَ ، وَالصَّبِيِّ حَتَّى يَعْقِلَ أَوْ يَحْتَلِمَ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ وَالْأَوْسَطِ ، وَقَالَ : لَا يُرْوَى عَنِ ابْنِ عَبَّاسٍ إِلَّا بِهَذَا الْإِسْنَادِ ، وَفِيهِ عَبْدُ الْعَزِيزِ بْنُ عُبَيْدِ اللَّهِ بْنِ حَمْزَةَ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Prophet (peace and blessings be upon him) said: "The pen has been lifted from three: from the one who is asleep until he wakes up, from the one who is mentally deficient until he recovers, and from the child until he attains understanding (the narrator is unsure whether the words are:) until he reaches puberty."
Al-Tabarani recorded it in al-Mu'jam al-Kabir and al-Mu'jam al-Awsat, and he said: It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) only with this chain. Its chain contains Abd al-Aziz bin Ubaydullah bin Hamzah, who is da'if (weak).
Al-Tabarani recorded it in al-Mu'jam al-Kabir and al-Mu'jam al-Awsat, and he said: It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) only with this chain. Its chain contains Abd al-Aziz bin Ubaydullah bin Hamzah, who is da'if (weak).
وَعَنْ أَبِي إِدْرِيسَ الْخَوَلَانِيِّ قَالَ : أَخْبَرَنِي غَيْرُ وَاحِدٍ مِنْ أَصْحَابِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - مِنْهُمْ شَدَّادُ بْنُ أَوْسٍ ، وَثَوْبَانُ : أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ :
" رُفِعَ الْقَلَمُ فِي الْحَدِّ عَنِ الصَّغِيرِ حَتَّى يَكْبُرَ ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَعَنِ الْمَجْنُونِ حَتَّى يُفِيقَ ، وَعَنِ الْمَعْتُوهِ الْهَالِكِ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَرِجَالُهُ ثِقَاتٌ .
" رُفِعَ الْقَلَمُ فِي الْحَدِّ عَنِ الصَّغِيرِ حَتَّى يَكْبُرَ ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَعَنِ الْمَجْنُونِ حَتَّى يُفِيقَ ، وَعَنِ الْمَعْتُوهِ الْهَالِكِ " .

Abu Idris al-Khawlani narrates: More than one of the Companions informed me of this, among them Sayyiduna Shaddad bin Aws (may Allah be pleased with him) and Sayyiduna Thawban (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said: "In the matter of the prescribed punishment (hadd), the pen has been lifted from the child until he grows up, from the one who is asleep until he wakes up, from the insane until he recovers, and from the one who is mentally deficient and utterly lost."
