بَابُ ذَكَاةِ الْمُتَرَدِّي وَنَحْوِهِ .

عَنْ أَنَسٍ ، عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنَّهُ سُئِلَ : مَا تَكُونُ الذَّكَاةُ إِلَّا فِي الْحَلْقِ وَاللَّبَّةِ ؟ فَقَالَ : " لَوْ طَعَنْتَ فِي فَخِذِهَا لَأَجْزَأَ عَنْكَ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ بَكْرُ بْنُ الشُّرُودِ ، وَهُوَ ضَعِيفٌ .

Sayyiduna Anas (may Allah be pleased with him) reports from the Prophet (peace and blessings be upon him) that he was asked: "Is slaughter only at the throat and the upper chest (labbah)?" He said: "If you were to pierce it (with an arrow or spear) in its thigh, that would also suffice for you."
Al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains Bakr bin al-Shurud, who is da'if (weak).

وَعَنْ رَافِعِ بْنِ خَدِيجٍ ، عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنَّ بَعِيرًا مِنْ إِبِلِ الصَّدَقَةِ نَدَّ فَطَلَبُوهُ ، فَلَمَّا أَعْيَاهُمْ أَنْ يَأْخُذُوهُ رَمَاهُ رَجُلٌ بِسَهْمٍ فَأَصَابَ مَقْتَلَهُ ، فَسَأَلُوهُ عَنْ أَكْلِهِ فَأَمَرَهُمْ بِأَكْلِهِ ، وَقَالَ : " إِنَّ لَهَا أَوَابِدَ كَأَوَابِدِ الْوَحْشِ ، فَإِذَا حَبَسْتُمْ مِنْهَا شَيْئًا فَاصْنَعُوا بِهِ مِثْلَ مَا صَنَعْتُمْ بِهَذَا ، ثُمَّ كُلُوهُ " .
قُلْتُ : هُوَ فِي الصَّحِيحِ بِاخْتِصَارٍ ، وَهَذَا أَبْيَنُ أَيْضًا .

Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) reports about the Prophet (peace and blessings be upon him): One of the camels of charity (sadaqah) bolted, and the people chased it. When it wore them out and they could not catch it, a man shot it with an arrow, and the arrow struck it in a place that killed it. The people asked the Prophet (peace and blessings be upon him) about eating its meat, and the Prophet (peace and blessings be upon him) instructed them to eat it. The Prophet (peace and blessings be upon him) said: "These animals also run wild, just as wild animals bolt. So when you cannot get control of any of them, do with that animal as was done with this one, and then eat its meat." (Allamah al-Haythami says:) I say: This narration is reported in the Sahih in abridged form, and this narration is clearer.

وَعَنْ رَافِعٍ قَالَ : كُنَّا مَعَ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - بِذِي الْحُلَيْفَةِ مِنْ تِهَامَةَ . قَالَ رَافِعٌ : ثُمَّ إِنَّ نَاضِحًا تَرَدَّى فِي بِئْرٍ بِالْمَدِينَةِ فَذُكِّيَ مِنْ قِبَلِ شَاكِلَتِهِ - يَعْنِي خَاصِرَتَهُ - فَأَخَذَ مِنْهُ عُمَرُ عَشِيرًا بِدِرْهَمٍ .

Sayyiduna Rafi' (may Allah be pleased with him) narrates: We were with the Prophet (peace and blessings be upon him) at Dhu al-Hulayfah, which is a place in Tihamah. Sayyiduna Rafi' (may Allah be pleased with him) narrates: A camel fell into a well in Madinah, and it was slaughtered from its flank. Sayyiduna Umar (may Allah be pleased with him) took a tenth of it for one dirham.

وَعَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ قَالَ : اتَّبَعْنَا بَقَرَةً فِي عَهْدِ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - لِنَسْرَكَ عَلَيْهَا فَانْفَلَتَتْ مِنَّا فَامْتَنَعَتْ عَلَيْنَا فَعَرَضَ لَهَا مَوْلًى لَنَا - يُقَالُ لَهُ : ذَكْوَانُ - بِسَيْفٍ فِي يَدِهِ وَهِيَ تَجُولُ بِالضِّمَادِ فَضَبَا إِلَى تَلٍّ فَلَمَّا مَرَّتْ بِهِ ضَرَبَهَا بِالسَّيْفِ فِي أَصْلِ عُنُقِهَا أَوْ عَلَى عَاتِقِهَا فَخَرَقَهَا بِالسَّيْفِ وَوَقَعَتْ فَلَمْ يُدْرِكْ ذَكَاتَهَا ، فَخَرَجْتُ أَنَا وَعَبْدُ اللَّهِ بْنُ ثَابِتِ بْنِ الْجِذْعِ ، فَلَقِينَا رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَذَكَرْنَا لَهُ شَأْنَهَا ، فَقَالَ : " كُلُوا ؛ إِذَا فَاتَكُمْ مِنْ هَذِهِ الْبَهَائِمِ شَيْءٌ فَاحْبِسُوهُ بِمَا تَحْبِسُونَ بِهِ الْوَحْشَ " .

Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates: In the blessed time of the Prophet (peace and blessings be upon him), we were going after a cow in order to catch it, but it kept escaping from us and we could not get control of it. A slave of ours named Dhakwan came in front of it with a sword in his hand. The cow went roaming towards a mound, and when it passed by him he struck the cow on its neck with the sword (the narrator is unsure, perhaps the words are:) struck it on its shoulder with the sword, and the sword tore it open. The cow fell, and there was no chance to slaughter it. Abdullah bin Thabit bin al-Jidh' and I went out and met the Prophet (peace and blessings be upon him). We mentioned the matter of the cow to him, and he said: "Eat it. When any animal of this kind escapes from your control, catch it the way you catch wild animals (or force it to stop)."
