Majma al-Zawaid — Hadith 7828

عَنِ ابْنِ عَبَّاسٍ قَالَ : كَانَ الرَّجُلُ إِذَا قَالَ لِامْرَأَتِهِ فِي الْجَاهِلِيَّةِ : أَنْتَ عَلَيَّ كَظَهْرِ أُمِّي حُرِّمَتْ عَلَيْهِ ، وَكَانَ أَوَّلَ مَنْ ظَاهَرَ فِي الْإِسْلَامِ رَجُلٌ كَانَ تَحْتَهُ ابْنَةُ عَمٍّ لَهُ يُقَالُ لَهَا : خُوَيْلَةُ ، فَظَاهَرَ مِنْهَا ، فَأُسْقِطَ فِي يَدِهِ ، وَقَالَ : أَلَا قَدْ حَرُمْتِ عَلَيَّ ، وَقَالَتْ لَهُ مِثْلَ ذَلِكَ ، قَالَ : فَانْطَلِقِي إِلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَسَلِيهِ ، فَأَتَتِ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَجَعَلَتْ تَشْتَكِي إِلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَأَنْزَلَ اللَّهُ - تَبَارَكَ وَتَعَالَى : ( قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللَّهِ ) إِلَى قَوْلِهِ : ( فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا ) فَقَالَتْ : أَنَا رَقَبَةٌ ، مَا لَهُ غَيْرِي ، قَالَ : فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ ، قَالَتْ : وَاللَّهِ إِنَّهُ لَيَشْرَبُ فِي الْيَوْمِ ثَلَاثَ مَرَّاتٍ ، قَالَ : ( فَمَنْ لَمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا ) قَالَتْ : بِأَبِي وَأُمِّي مَا هِيَ إِلَّا أَكْلَةٌ إِلَى مِثْلِهَا ، لَا نَقْدِرُ عَلَى غَيْرِهَا ، فَدَعَا النَّبِيُّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - بِشَطْرِ وَسْقٍ ثَلَاثِينَ صَاعًا ، وَالْوَسْقُ : سِتُّونَ صَاعًا ، فَقَالَ : " لِيُطْعِمْهُ سِتِّينَ مِسْكِينًا وَلْيُرَاجِعْكِ " .
رَوَاهُ الْبَزَّارُ ، وَفِيهِ أَبُو حَمْزَةَ الثُّمَالِيُّ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: In the Days of Ignorance, when a man said to his wife, "You are to me like the back of my mother," she would become unlawful for him. The first zihar in Islam was done by a man whose wife was his paternal cousin; his wife's name was Khuwaylah. That man declared zihar on her, and then he regretted it. He said, "You have become unlawful for me." She said the same to him. He said, "Go to the Prophet (peace and blessings be upon him) and ask the Prophet (peace and blessings be upon him) about this." She came to the Prophet (peace and blessings be upon him) and complained to the Prophet (peace and blessings be upon him) about it. Then Allah Almighty revealed this verse: "Allah has indeed heard the statement of the woman who argues with you concerning her husband and complains to Allah." The verse continues up to: "Then (the expiation is) freeing a slave before the two of them touch one another." She said, "There is only me; apart from me he has no one (no slave or slave woman)." The Prophet (peace and blessings be upon him) said, "Then fasting two consecutive months." She said, "By Allah! He drinks three times a day." The Prophet (peace and blessings be upon him) said, "Whoever is unable to do that, then (the expiation is) feeding sixty poor people." She said, "May my father and mother be sacrificed for you! He has only enough food for his need; we cannot obtain anything more than that." So the Prophet (peace and blessings be upon him) called for half a wasq, that is, thirty sa', since one wasq is sixty sa'. The Prophet (peace and blessings be upon him) said, "Let him feed these dates to sixty poor people, and then let him take you back."
Al-Bazzar recorded it. Its chain contains a narrator, Abu Hamzah al-Thumali, and he is da'if (weak).
